Tiesas sprieduma piespiedu izpilde ir ļoti nozīmīgs un, jāatzīst, arī ļoti komplicēts civilprocesuāls jautājums. Ne vienmēr efektīvais un ātrais nolēmuma izpildes process, kam ir tendence iesaistīt arī ārvalsts elementu, rada nepieciešamību attīstīt un pilnveidot civilprocesuālo regulējumu attiecībā uz sprieduma piespiedu izpildi. Progresējot dažādām mūsdienīgām tehnoloģijām un cilvēku ikdienā ienākot ar vien jauniem līdzekļiem, kas piedāvā atšķirīgās situācijās uzlabotus risinājumus, civilprocess nedrīkst ieņemt stagnējošu stāvokli. Maģistra darba mērķis ir pilnveidot Latvijas civilprocesuālo regulējumu attiecībā uz tiesas nolēmumu piespiedu izpildi, kas vērsta pret juridiskas personas naudas līdzekļiem, novēršot temata izpētes gaitā konstatētos problēmjautājumus. Lai izvirzītais mērķis būtu sasniegts, darba ietvaros ir apzinātas pastāvošās problēmas nolēmumu piespiedu izpildē, analizēta tiesu prakse, ārvalstu normatīvais regulējums, Eiropas Savienības tiesību akti. Maģistra darba rezultātā ir izteikti secinājumi par pastāvošā regulējuma ietekmi uz parādu piedziņas procesu no juridiskās personas skaidras un bezskaidras naudas līdzekļiem. Papildus tam, ir sniegti priekšlikumi pilnveidot Latvijas civilprocesuālo regulējumu attiecībā uz sprieduma piespiedu izpildi, lai pēc iespējas pilnīgāk nodrošinātu tiesību uz taisnīgu tiesu realizēšanos. Forced execution of a court judgement is a very important, but, I have to admit, also a very complicated civil procedural issue. Not always the effective and fast execution process of the judgement, having a trend to involve also a foreign element, cause a need to develop and improve the civil procedure regulation with regard to the forced execution of the judgement. When various modern technologies make a progress and even more new aids enter into the daily life of humans, offering improved solutions for different situations, the civil procedure cannot take a stagnant position. Purpose of this Master’s Paper is to improve the civil procedure regulation of Latvia with regard to forced execution of court judgements, directed towards monetary funds of a legal person, eliminating the issues established during the course of research of the topic. In order to achieve the proposed target, the current problems in forced execution of judgements are studied, as well as case law, foreign normative regulation and legal acts of the European Union are analysed within the framework of the Paper. The Master's Paper results in conclusions made regarding the effect of the existing regulation on the process of debt recovery from cash and non-cash funds of a legal person. Besides, recommendations are provided for improvement of civil procedure regulation of Latvia with regard to forced execution of the judgement in order to ensure implementation of the right to fair court as much as possible.
