Maģistra darba nosaukums ir ’’Seju aizsedzoša reliģiska apģērba nēsāšanas aizlieguma juridiskie aspekti’’. Paredzot aizliegumu publiskās vietās nēsāt seju aizsedzošu apģērbu, var tikt ierobežotas personas tiesības uz reliģijas brīvības ārējo izpausmi, jo reliģijas brīvības ārējā izpausme ietver arī galvassegu nēsāšanu, kas it sevišķi ir attiecināms uz musulmaņu sievietēm. Šobrīd Latvijā tiek izstrādāts likums, ar kuru tiek plānots aizliegt publiskās vietās nēsāt seju aizsedzošu apģērbu. Tādējādi ir nepieciešams apzināt, izpētīt un izvērtēt tos juridiskos aspektus saskaņā ar kuriem šāds ierobežojums būtu atzīstams par tiesisku. Maģistra darba mērķis ir to juridisko aspektu noskaidrošana un izvērtēšana, kas valstīm, tai saitā Latvijai, ir jāņem vērā, ieviešot seju aizsedzoša apģērba nēsāšanas aizliegumu publiskās vietās, lai personas tiesību uz reliģijas brīvību ierobežošana tiktu atzīta par tiesisku. Darba rezultātā autore secina, ka ieviešot šādu ierobežojumu, valstīm obligāti ir jāievēro likuma trīs kvalitātes kritērijus. Tāpat pastāv vairāki ierobežojuma leģitīmie mērķi, bet ne vienmēr un ne visos individuālajos gadījumos tie tiek atzīti par pamatotiem, jo valstīm vienmēr ir jāizvērtē ierobežojuma nepieciešamība demokrātiskā sabiedrībā: ierobežojuma samērība ar leģitīmo mērķi, sociālā nepieciešamība un likumdevēja rīcības brīvības robežas nepārsniegšana. The title of the Master Thesis is: “Legal aspects of the prohibition to wear religious garments covering the face’’. By imposing a prohibition to wear in public religious garments covering the face, the rights of individuals to external expression of their freedom of religion may be restricted, as wearing of headscarves is one of the expressions of religious belief, particularly attributable to Muslim women. Currently it is worked upon the elaboration of a Latvian draft law which potentially will prohibit wearing of religious garments covering the face in public. This process entails the necessity to understand, study and evaluate those legal aspects by which such a restriction could be recognized legitimate. The scope of the Master thesis is to identify and assess those legal aspects which have to be taken into consideration for countries, Latvia among them, introducing a law prohibiting public appearance with religious garments covering the face, in order such a limitation of individuals’ freedom of religion would be recognized legitimate. As a result of the research, the author has concluded that for the purpose of introducing such a limitation, it is mandatory for the countries to observe three quality criteria of the law. Although the limitation pursues a number of legitimate aims, such will not always be recognized reasonable, considering that it is always necessary to evaluate the necessity of a certain limitation within a democratic society: proportionality of the prohibition with its legitimate aim, social necessity and the observance of the margin of appreciation by the legislators.
