Valsts valodas likuma efektivitāte

Abstract

Maģistra darbā "Valsts valodas likuma efektivitāte" ir pētīti jautājumi, kas saistās ar valsts un pašvaldību iestāžu darbinieku valsts valodas lietojumu un ar publiski sniegtās informācijas nodrošināšanu atbilstoši normatīvo aktu prasībām. Maģistra darba mērķis ir izvērtēt Valsts valodas likuma efektivitāti. Lai sasniegtu mērķi, izvirzīti šādi uzdevumi: 1) izvērtēt valsts valodas politikas veidošanas un īstenošanas efektivitāti; 2) izpētīt valsts valodas tiesisko regulējumu un tā efektivitāti; 3) veikt valsts valodas lietojumu regulējošo normatīvo aktu piemērošanas praktisko izpēti, kas saistīta ar darbinieku valodas lietojumu un informācijas sniegšanu publiskajā un privātajā sfērā; 4) secināt, vai valsts valodas tiesiskais regulējums tiek ievērots publisko un privāto iestāžu darbībā; 5) iepazīties ar statistikas materiāliem par pie administratīvās atbildības sauktajām personām, lai salīdzinātu un secinātu, kā tiek nodrošinātas normatīvo aktu prasības pašvaldību dibinātajās iestādēs; 6) analizēt Valsts valodas centra administratīvo pārkāpumu lietu materiālus un tiesu praksi; 7) izdarīt secinājumus, kā arī sniegt priekšlikumus normatīvo aktu pilnveidei. Maģistra darbs strukturēts trīs nodaļās ar apakšnodaļām. Pirmajā nodaļā izvērtēta valsts valodas politikas veidošanas efektivitāte un institūcijas, kas īsteno valsts valodas politiku, efektivitāte. Otrajā nodaļā pētītas pašvaldību darbinieku un deputātu valsts valodas lietojuma problēmas. Trešajā nodaļā pētītas valsts valodas lietojuma problēmas valsts un pašvaldību sniegtajā informācijā. Maģistra darba noslēgumā izdarīti secinājumi un sniegti priekšlikumi normatīvo aktu pilnveidei, lai nodrošinātu pilnīgu valsts valodas lietojuma efektivitāti publiskajā un privātajā sfērā. Maģistra darbs sastāv no 80 lappusēm, 1 tabulas, 7 attēliem un pielikumiem. Darba praktiskajā daļā veikta pielikumu un statistikas analīze, kā arī pētīta un analizēta tiesu prakse. The issues related to the usage of the official language by employees of the state and local government institutions are researched in the master paper „Efficiency of the Official Language Law”, and the provision of publicly provided information in conformity with the requirements of laws and regulations. The target of the master paper is to assess the efficiency of the Official Language Law. In order to achieve the target, the following tasks have been defined: 1) to assess the efficiency of development and implementation of the official language policy; 2) to research legal framework of the official language and efficiency thereof; 3) to carry out practical research of the application of laws and regulations governing the usage of the official language that is related to the usage of the language by employees and provision of information in the public and private sector; 4) to conclude if the legal framework of the official language is observed in the activities of public and private institutions; 5) to become familiar with statistics materials regarding persons to be held administratively liable in order to compare and conclude how the requirements of laws and regulations are ensured in the institutions established by local governments; 6) to analyse materials and case-law of the administrative infringements at the disposal of the State Language Centre; 7) to make conclusions, and also to provide proposals for the improvement of laws and regulations. The master paper is organised in three chapters with sub-chapters. The efficiency of the creation of the official language policy and institutions which implement the efficiency of the official language policy are assessed in the first chapter. The problems of the usage of the official language by employees and deputies of local governments are researched in the second chapter. The problems of the usage of the official language in the information provided by the state and local governments are researched in the third chapter. The conclusions are made and proposals for the improvement of laws and regulations are provided in the end of the master paper, in order to ensure complete efficiency of the usage of the official language in the public and private sector. The master paper consists of 80 pages, 1 table, 7 pictures and annexes. The analysis of the annexes and statistics are carried out in the practical part of the paper, as well as case-law has been researched and analysed therein.
