Maģistra darba tēma “Vienošanās kriminālprocesā”. Darbā aplūkota vienošanās procesa vēsturiskā izcelsme un rašanās priekšnoteikumi ASV. Minētās tēmas aktualitāte ir tajā, ka vienošanās par vainas atzīšanu un sodu ir Latvijai jauns tiesību institūts. Līdz ar to rodas virkne jautājumu, kas saistīti ar vienošanās izpratni, priekšnoteikumiem, atsevišķu likuma normu piemērošanu. Darbā izpētīta vienošanās jēdziena izpratne, vienošanās par vainas atzīšanu un sodu priekšnoteikumi Latvijas Kriminālprocesā. Izpētīta virkne problēmjautājumu, kas saistīti ar cietušā tiesību realizāciju piemērojot vienošanās procesu, prokurora loma vienošanās procesa piemērošanā. Tāpat apsūdzētā procesuālās garantijas vienošanās procesā. Maģistra darba ietvaros izpētīti arī vienošanās institūts un tā piemērošana Krievijas federācijas, Itālijas Republikas un Vācijas kriminālprocesuālajā regulējumā. Theme of the Master`s thesis is "Plea bargaining in criminal proceedings ". The thesis is looking into historical background and origins of Plea bargaining and origins in Unites States. The relevance of this subject is that Plea bargaining and bargaining for the punishment procedure is new to Latvia and taken from case law institutes. Consequently, a number of questions arise which are related to understanding of the agreement, preconditions and application of separate legal norms. Thesis explores the understanding of the concept of an agreement, the agreement on the recognition of guilty and the preconditions for sentences in Latvian Criminal Proceedings, of issues related to the implementation of the victim's rights through the application of the agreement process, the role of the prosecutor in applying the agreement process as well as the procedural safeguards agreement of the accused has been explored. The Master's Thesis also explores the agreement and its application in the criminal law of the Russian Federation, the Italian Republic and Germany.
