Darbā tiek pētīts tiesas nolēmumu izpildes institūts administratīvajā procesā. Autore kā galveno problēmu izvirza tiesas nolēmuma izpildes nepietiekošu efektivitāti, kas var radīt pamattiesību uz taisnīgu tiesu aizskārumu. Pētījuma mērķis ir novērtēt tiesas nolēmuma izpildi administratīvajā procesā, kā arī radoši meklēt uzlabojumus tajā. Pētījuma mērķu sasniegšanai, autore ir izvirzījusi sekojošus uzdevumus: izpētīt tiesas nolēmuma izpildes institūta tiesisko regulējumu; veikt šī tiesību institūta tiesu prakses izpēti; veikt tiesas nolēmuma piespiedu izpildei piemērojamo tiesību normu salīdzinājumu ar citās valstīs esošo regulējumu; izstrādāt priekšlikumus tiesas nolēmuma izpildes efektivitātes uzlabošanai. Pētījuma rezultātā autore piedāvā priekšlikumus papildināt un grozīt spēkā esošās tiesību normas saistībā ar tiesas nolēmuma izskaidrošanu, izpildes sadalīšanu termiņos, izpildes seku novēršanu un sūdzības iesniegšanas termiņu. Autore arī norāda jomas, kur būtu novēršama neefektivitāte (kļūdas) esošo tiesību normu piemērošanā. Turklāt autore izstrādājusi kritēriju kopumu, kuri būtu izvērtējami tiesai, skatot prasījumu par nemantiskā kaitējuma atlīdzinājumu saistībā ar tiesas nolēmuma nepienācīgu vai neatbilstošu izpildi. The work examines execution of a court ruling in the administrative procedure. The author as the main problem discovered the insufficient efficiency of execution of a court ruling that may lead to a violation of the fundamental right to a fair trial. The aim of the study is to assess the execution of a court ruling in the administrative procedure, as well as to seek out creative improvements in this area. In order to achieve the research goals, the author has put forward the following tasks: to study the legal regulation on the subject; to analyze the case law on the subject; to make a comparison of legal regulation applicable to enforcement of a court ruling with the regulations existing in other countries; to develop proposals for improving the efficiency of execution of a court ruling. As a result of the research, the author proposes to supplement and amend the existing legal provisions regarding: the interpretation of a court ruling, request for changes in the execution time frame, prevention of execution consequences and the deadline for lodging a complaint. The author also indicates areas where the inefficiency (errors) of the existing case law should be eliminated. In addition, the author has developed a set of criteria to be assessed by the court when considering a claim for compensation for non-pecuniary damage in connection with improper or inadequate execution of a court ruling.
