Maģistra darba tēma ir valsts amatpersonu kriminālprocesuālā imunitāte, liekot uzsvaru uz Latvijas tiesību avotos noteiktiem valsts amatpersonu imunitātes subjektiem kā: parlamenta deputātiem, valsts prezidentu, tiesnešiem, prokuroriem, Valsts drošības iestāžu un Korupcijas novēršanas un apkarošanas biroja amatpersonām un tiesībsargu. Imunitātes regulējums nostāda minētās amatpersonas priviliģētākā stāvoklī, līdz ar to tiek sarežģīta kriminālprocesa gaita attiecībā uz personām, nosakot īpašu procesuālu regulējumu, kas rada vairāku pamatprincipu kolīzijas. Maģistra darba uzdevumi ir izpētīt valsts amatpersonu kriminālprocesuālās imunitātes saturu, konstatēt pamatojumu tās apjomam, izpētīt ar tās atcelšanu saistīto procedūru, veikt tiesību avotu analīzi un izteikt priekšlikumus regulējuma pilnveidošanai pēc nepieciešamības. Darba gaitā autore nonākusi pie vairākiem secinājumiem, kas apliecina imunitātes institūta nepilnības. Kriminālprocesuālās imunitātes regulējums normatīvajos aktos ir papildināms atbilstoši esošajai situācijai un normatīvo aktu izmaiņām. The topic of this master’s thesis is the criminal procedural immunity of state officials. The following enlists those subjects whose criminal procedural immunity, owing to their state official’s status, is regulated in sources of Latvian law: members of the parliament, the president, judges, public prosecutors, the ombudsman, the officials of the institutions that deal with state security and the officials of the Corruption Prevention and Combating Bureau of Latvia (KNAB). By imposing a special procedural regulation that creates a collision of numerous basic principles, state officials are put in a more privileged position, thus complicating the course of the criminal proceedings that have been initiated against them. The main tasks of the thesis are to research the content of the criminal procedural immunity of state officials, to establish a legal ground, as to why it is so extensive, to find out what the immunity-cancellation procedure is, to analyze the corresponding legal sources and suggest any improvements necessary. The authoress has come to conclusions that confirm that there are deficiencies in the current regulation of the criminal procedural immunity of state officials. Therefore, it needs to be improved according to the current situation and the latest legal changes.
