Standarta formu cīņa (“battle of forms”) ir izplatīta problēma starptautiskajās tirdzniecības tiesībās, ar kur sastopas tiesas gadījumā, ja puses panāk vienošanos par līguma noslēgšanu, taču nevienojas par piemērojamajiem standarta noteikumiem. Pētījuma mērķis ir izpētīt no ANO Konvencijas par starptautiskajiem preču pirkuma pārdevuma līgumiem izrietošās standarta formu cīņas metodes, to piemērošanas priekšnosacījumus, efektivitāti un nepilnības. Pamatojoties uz secinājumiem, pēc analoģijas izpētīt kā standarta formu cīņa var tikt risināta Latvijas normatīvā regulējuma ietvaros, kurš šobrīd neregulē minēto jautājumu, un secināt, kādi uzlabojumi būtu ieteicami Latvijas Civillikumā. Autore secina, ka standarta formu cīņas rašanās priekšnosacījums ir standarta noteikumu inkorporācija līgumā. Autore konstatē, ka konvencijas dominējošā un Latvijas civiltiesībām pamērotākā standarta formu cīņas risināšanas doktrīna ir “last-shot” (“pēdējā šāviņa”) doktrīna. Taču tā kā “last-shot” doktrīna tiek plaši kritizēta, atbalstu sāk gūt alternatīvā “knock out” (“izsišanas”) doktrīna. Tāpēc līguma pušu līdztiesību nodrošināšanai standarta formu cīņas gadījumā Latvijas civiltiesībās būtu ieteicams inkorporēt “knock-out” doktrīnas konceptu. Battle of forms is a widespread problem of international trade law, which occurs in case contracting parties conclude an agreement not reaching a consent on applicable standard terms to the agreement. The aim of the research is to analyses doctrines and methods stemming from the UN Vienna Convention on sales of goods to solve the battle of forms, their efficiency and defects, as well as establish preconditions, which lead to the occurrences of the battle of forms. Based on the conclusions made, by analogy with the convention the author analyses how battle of forms problem might be solved under the law of Latvia, which currently contains no regulation on the issue, and determines suggestive amendments to the Latvian Civil Code. The author has concluded that the main precondition of the battle of forms is proper incorporation of standard terms into the contract. It is determined that “last-shot” doctrine not only is a governing battle of forms doctrine under the Convention, but also the most suitable doctrine for the Latvian Civil Code. However, “last-shot” doctrine is widely criticized, and therefore preference is given to the “knock-out” doctrine. As a result, to ensure equality of arms of contracting parties it is suggested to incorporate into Latvian Civil Code a provision which reflects the main concept of the “knock-out” doctrine.
