Publiskas lietas, kas var piederēt privātpersonai

Abstract

Maģistra darbā “Publiskas lietas, kas var piederēt privātpersonai” ir analizēts modificētais privātīpašums, kas konstatējams gadījumā, kad publiska lieta vai tās daļa atrodas privātpersonas īpašumā. Darbā pētīti privāto ūdeņu publiski tiesiskie lietošanas tiesību aprobežojumi, tauvas joslas lietošanas tiesību aprobežojumi un īpaši aizsargājamo dabas teritoriju lietošanas tiesību ierobežojumi. Darbā konstatēts privāto ūdeņu, kuros zvejas tiesības pieder valstij, tauvas joslas un īpaši aizsargājamo dabas teritoriju piešķīrums un publiskās lietas veids. Izpētīts modificētā privātīpašuma parastās un sevišķās lietošanas apjoms un tā ietekme uz īpašnieka lietošanas tiesību apjoma samazināšanos.

Master thesis “Public things that could be in private possession” analyses modified private property which is used when public thing or person of it is owned by private person. The thesis researched the rights and limitations to public usage of private owned waterways, waterway banks and specially protected natural territories. The work looked at and stated the types of public things and legal rights assignment of privately owned waterways, where fishing rights belongs to the State, privately owned waterway banks and specially protected nature territories. The thesis also investigated the extent of basic and special usage of modified private property and how it limits the usage rights of the owner.
