Autores izvēlētais maģistra darba temats ir “Izmeklēšanas tiesneša institūts”. Cilvēktiesību garantēšana ir viens no demokrātiskās valsts pamatprincipiem, kurš jāievēro, veicot kriminālprocesu. Lai nodrošinātu cilvēktiesību ievērošanu pirmstiesas kriminālprocesā un nepieļautu neattaisnotu iejaukšanos personas dzīvē, tika ieviests izmeklēšanas tiesneša institūts. Darba mērķis ir izpētīt izmeklēšana tiesneša institūta būtību un nozīmi pirmstiesas kriminālprocesā, kā arī funkcijas. Darba uzdevumi: izpētīt Kriminālprocesa likuma regulējumu un izmeklēšanas tiesneša praksē pieņemtos lēmumus, izanalizēt izmeklēšanas tiesneša funkcijas, iepazīties ar ārvalsts regulējumu. Iegūtie rezultāti: iegūts priekštats par izmeklēšanas tiesneša funkcijām, ņemot vērā normatīvo regulējumu un izmeklēšanas tiesneša lēmumus. Apkopoti apcietinājuma piemērošanas pamati. The authors chosen Master Thesis is “Investigating judge in Latvia”. Guaranteeing of human rights is one of the fundamental principles of democratic state, which must be observed to realize criminal process. To be sure, that human rights are respect in a pre-trial investigation and exclude unwarranted interference of person’s life, was introduce an institute of investigating judge. The aim of Master Thesis is to explore nature and importance of an institute of investigation judge in pre-trial investigation, as well as functions. The objective of Master Thesis: to explore Latvian law of criminal procedure and investigating judge decisions, to analyse investigating judge functions, to get acquainted with regulation of foreign country. The result: the summary of investigating judge function, considering normative regulation and investigating judge decisions. The summary of the foundation of pre-trial arrest.
