Maģistra darba nosaukums ir “Digitāli glabāta informācija kā pierādījumi civilprocesā”. Tēmas problemātika saistīta ar digitāli glabātas informācijas iekļaušanu rakstveida pierādījumu tvērumā, neņemot vērā tās specifiskās iezīmes. Maģistra darba mērķis ir izpētīt digitālas formas pierādījumu civilprocesā regulējumu un praksi, risināt jautājumu par nepieciešamību izstrādāt detalizētāku regulējumu. Lai sasniegtu izvirzīto mērķi, tiks analizēts digitāli glabātas informācijas jēdziens un būtība, normatīvais regulējums un tiesu prakse. Tāpat tiks salīdzināts Latvijas un ārvalstu regulējums šajā jomā, analizēti novērtēšanas un ticamības aspekti. Darba izstrādes rezultātā tika secināts, ka tiesām nav skaidras izpratnes par digitāli glabātas informācijas būtību un pieļaujamību. Rakstveida pierādījumu noteikumi ne vienmēr var tikt piemērojami attiecībā uz digitāli glabātu informāciju. The topic of the master thesis is “Digitally stored information as an evidence in civil procedure”. The problem of the topic is related to digitally stored information being included in the scope of written evidence, without taking into account its specific features. The objective of this study is to research regulatory framework and practice of evidence in digital form in civil procedure, to address the need for more detailed regulation. In order to achieve the objective, the concept, essence, regulation and jurisprudence will be analyzed. Also Latvian and foreing regulation in this field will be compared and aspects of assessment and credibility analyzed. As a result of work it was concluded that the courts do not have a clear understanding of the nature and admissibility of digitally stored information. Rules that apply to written evidence may not always be applicable to digitally stored information.
