Maģistra darbā “Tiesvedības apturēšana civilprocesā” pētīts Latvijas Republikas Civilprocesa likumā regulētais tiesvedības apturēšanas institūts un tā piemērošanas problemātika, kā arī darba nobeigumā aplūkots Civilprocesa likumā nepārņemtais “blakus procesa” jēdziens, kura izpratne un iespējama expressis verbis ieviešana Civilprocesa likumā varētu būt lietderīga, lai veicinātu izpratni par apturētā tiesvedībā blakus procesa kārtībā izskatāmajiem jautājumiem. Proti, tādiem jautājumiem, kas nav saistīti ar lietu pēc būtības, bet kuru izskatīšana bez liekas kavēšanās ir nepieciešama tiesvedībā iesaistīto pušu tiesību uz taisnīgu tiesu nodrošināšanai. Darba ietvaros ir izpētīts tiesvedības apturēšanas institūta jēdziens un regulēšanas priekšmets, nošķirot šo institūtu no tādiem pēc vairākām pazīmēm līdzīgiem procesuālajiem instrumentiem kā lietas izskatīšanas atlikšana un tiesas sēdes pārtraukšana. Autors pētījis arīdzan institūta ģenēzi Latvijas teritorijā, kā arī tiesvedības apturēšanas pamatus, sistēmu un piemērojamību tiesvedības veidiem un stadijām. Pētījuma rezultātā autors piedāvā konstatēto problēmjautājumu risinājumus ar mērķi uzlabot izpratni par tiesvedības apturēšanas institūta pareizu piemērošanu, tādējādi stiprinot procesuālās ekonomijas principu civillietu izskatīšanā. The master’s thesis “Suspension of proceedings in civil procedure” examines the proceedings suspension institute regulated by the Civil Procedure Law of the Republic of Latvia and the problematics of its application, as well as the forgotten concept of “adjacent proceedings” which was not inherited in the Civil Procedure Law, but the understanding of which and even possible expressis verbis inclusion in the Civil Procedure Law could be useful in raising awareness on actions which can be resolved during suspended proceedings. Namely, issues not related to the substance of the case, but which are necessary to be resolved without undue delay in order to ensure the rights to a fair trial of the parties. Within the framework of the master’s thesis, the concept and object of regulation of the proceedings suspension institute has been explored, distinguishing the institute from such procedural instruments as postponement of proceedings and interruption of the court session which are similar by several features. Also the author has studied the genesis of the institute within the territory of Latvia as well as the suspension grounds, system and the applicability to the types and stages of proceedings. As the result of the research, the author presents solutions to the identified problems with the aim of improving understanding of the correct application of the proceedings suspension institute, thus strengthening the principle of procedural economy in civil procedure.
