Kriminālatbildība par stratēģiskas nozīmes preču apriti

Abstract

Šis darbs ir nozīmīgs tāpēc, ka iepriekš netika detalizēti izvērtēti kriminālatbildības par stratēģiskas nozīmes preču aprites nosacījumi un problēmjautājumi. Kriminālatbildības iestāšanās par stratēģiskas nozīmes preču aprites pārkāpumiem ir svarīgs priekšnoteikums valsts drošības, sabiedriskās kārtības un tautsaimniecības interešu ievērošanai, jo stratēģiskas nozīmes preču patvaļīga, nelikumīga izmantošana var novest pie terorisma un sadursmju draudiem valstī. Darba mērķis ir izpētīt stratēģiskas nozīmes preču aprites kontroles regulējumu Latvijas Republikas normatīvajos aktos, salīdzināt to ar ārvalstu tiesību avotiem, kā arī izanalizēt Krimināllikumā ievērtā regulējuma nodalīšanu no Administratīvo pārkāpumu kodeksa, apskatot trūkumus un izvērtējot iespējamus risinājumus. Atšķirībā no ārvalstu Krimināllikumos ietvertā regulējuma, Latvijas nacionālais regulējums nodala atbildību par stratēģiskas nozīmes preču aprites pārkāpumiem no panta, kas ietver atbildību par kontrabandu. Trūkumi pastāv attiecībā uz kriminālatbildības pastiprinošiem apstākļiem, atsevišķu jēdzienu neietveršanu Krimināllikuma normās, kā arī attiecībā uz tiesību normu struktūru. Izvērtējot Krimināllikuma un Administratīvo pārkāpumu kodeksa normas, pastāv tiesību normu piemērošanas problemātika. This research is important because of the lack of a prior assessment of the conditions and issues of criminal responsibility for the circulation of goods of the strategic significance. Criminal liability for violations of strategic goods is an important prerequisite for observance of the interests of national security, public order and national economy, because the arbitrary, illegal use of strategic goods can lead to the threat of terrorism and clashes in the country. The aim of the research is to investigate the control of the circulation of strategic goods in the regulatory enactments of the Republic of Latvia, to compare it with sources of foreign law, and to analyze the separation of the regulatory framework outlined in the Criminal Law from the Code of Administrative Offenses, by looking at deficiencies and evaluating possible solutions. By comparing the regulations in the foreign Criminal Law with the Latvian national regulation, unlike some foreign sources of law, Latvian national regulation separates responsibility for violations of the circulation of the strategic goods from the article which includes liability for smuggling. Disadvantages exist in relation to the aggravating circumstances of criminal liability, the exclusion of certain concepts from the Criminal Law, as well as the structure of legal norms. Having assessed the norms of the Criminal Law and the Code of Administrative Offenses, there is a problem of the application of legal norms.
