Aizdomās turētais un tā statusa vēsturiskais raksturojums

Abstract

Kriminālprocesa likuma I sadaļa “Kriminalprocesā iesaistītās personas” nosaka to personu loku, kurām procesā ir konkrētas tiesības un pienākumi, t.i., gan kriminālprocesa virzošās personas, gan personas kuras īsteno aizstāvību. Viens no procesa dalībniekiem, kurš īsteno aizstāvību ir aizdomās turētais. Bakalaura darba ‘’Aizdomās turētais un tā statusa vēsturiskais raksturojums’’ mērķis ir izpētīt kriminālprocesa dalībnieka- aizdomās turētā jēdzienu, tiesību un pienākumu vēsturisko attīstību un salīdzināt to ar mūsdienu regulējumu, kā arī ārvalstu regulējumu. Darbs sastāv no trim nodaļām un vairākām apakšnodaļām. Pirmajā nodaļā apskatīts aizdomās turētā jēdziena un statusa vēsturiskais raksturojums. Otrajā nodaļā apskatīts aizdomās turētā jēdziens un statuss mūsdienu likuma izpratnē. Trešajā nodaļā apskatīts aizdomās turētā institūts ārvalstīs, apskatot Igaunijas, Krievijas un Lietuvas regulējumus. Bakalaura darba nobeigumā ir izdarīti secinājumi, kā arī izvirzīti priekšlikumi.

The First Division of Criminal procedure Law “Persons involved in Criminal Proceedings” determines the circle of people who have concrete rights and duties during the process, that means both persons performing criminal procedure and persons performing defence. One of the participants of proceeding who performs defence is suspect. The aim of the bachelor’s thesis “Persons involved in criminal proceedings” is to investigate concept of criminal proceeding participant – suspect, as well as historical development of its rights and duties, then compare it with contemporary regulation of the Law and regulation of the Law in foreign states. The bachelor’s thesis consists of three sections and some subsections. The first section performs the historical description of the concept and status of suspect. The second section performs the concept and status of suspect within the scope of the contemporary law. The third section performs the institution of suspect in foreign states including regulation of the Law in Estonia, Russia and Lithuania. The final part of the bachelor’s thesis performs conclusions and suggestions.
