Taisnīguma atjaunošana Valsts probācijas dienesta organizētā izlīgumā

Abstract

Izlīgums ir brīvprātīga cietušā un likumpārkāpēja tikšanās un iesaistīšanās sarunā ar starpnieka palīdzību, lai kopīgi runātu par notikušo un meklētu abām pusēm pieņemamu un savstarpēji taisnīgu risinājumu. Izlīguma pamatā tiek izmantota taisnīguma atjaunošanas pieeja noziedzīga nodarījuma rezultātā radušos seku mazināšanā. Bakalaura darba mērķis ir analizēt, kā un cik efektīvi Valsts probācijas dienestā tiek organizēts izlīgums un izlīguma sanāksme. Darba uzdevumi ir analizēt Latvijas regulējumu, statistikas datus, kā arī tiesību doktrīnā paustās atziņas. Pētījuma rezultātā autore gūst ieskatu Valsts probācijas dienesta rīkota izlīguma procedūrā un konstatē atsevišķus problēmjautājumus. Darbā iekļautas 3 nodaļas ar apakšnodaļām. Darba apjoms ir 40 lappuses.

Conciliation is a voluntary meeting and intervention of the victim and offender, with the help of an intermediary, to talk together about what has happened and to seek an acceptable to both parties and mutually fair solution. The settlement is based on a justice-restoration approach to reduce the consequences of a criminal offense. The aim of the Bachelor's thesis is to analyze how and in what way the Conciliation and Settlement Meeting is organized in the State Probation Service. The tasks of the work are to analyze the regulation of Latvia, statistical data, as well as the lessons expressed in the legal doctrine. As a result of the research, the author gains insights into the conciliation procedure organized by the State Probation Service and identifies some problematic issues. The work includes 3 chapters with sub-chapters. The volume of work is 40 pages.
