Godīgums kā tiesneša ētikas cenzs tiesu varas neatkarības nodrošināšanā

Likumdevējs ilgstoši bija noteicis, ka par tiesnesi var strādāt tikai augsti kvalificēts un godīgs jurists. Līdz ar pēdējo grozījumu stāšanos spēkā 2018. gada 12. februārī godīguma kritēriju ir nomainījusi nevainojamas reputācijas prasība, argumentējot, ka godīgums aptveras ar nevainojamu reputāciju. Šī darba mērķis ir noskaidrot godīguma kā tiesneša ētikas cenza saturu un tā nozīmi tiesu varas neatkarības nodrošināšanā. Darba ietvaros autore analizē tiesu varas neatkarības nozīmi, pēta godīgumu no dažādiem aspektiem, analizē, kā Tiesnešu ētikas komisijas atziņās raksturots godīgums, un visbeidzot, definējot godīgumu kā tiesneša ētikas cenzu, salīdzina, vai to aptver nevainojamas reputācijas prasība. Rezultātā autore secina, ka godīgs jurists ne tikai rīkosies atbilstoši augstām morāles normām, radot sabiedrības uzticību (kas sakrīt ar nevainojamas reputācijas kritērija pieprasīto), bet arī pats iekšēji būs pārliecināts par savu godīgumu. Lai nodrošinātu augstāku tiesnešu standartu, autore piedāvā likumā atgriezt ētikas cenzu “godīgs jurists”. The legislator has continuously imposed that only a highly-qualified and honest lawyer may become a judge. Since the last amendments entered into force in 12 February 2018, the criterion of integrity has been substituted by the requirement of flawless reputation arguing that flawless reputation coincides with integrity. The aim of this paper is to clarify the content of integrity as a quality of judge's ethical standard and its role in the assurance of the independence of the judiciary. Within the framework of the paper, the author analyzes the significance of judiciary independence, researches the many aspects of integrity, analyzes how integrity is described in the quotes of the Judicial Ethics Commission, as well as compares the definitions of integrity to clarify whether it is included in the requirement of flawless reputation. As a result, the author concludes that an “honest lawyer’s” actions meets certain high moral principles in the society to the point that he/she enjoys public confidence. “Honest lawyer” incorporates not only the appearance of honest actions, but also being honest, as well as inner confidence about the conformity of one's actions to integrity; therefore, the author recommends including the requirement of “honest lawyer” in the law in order to ensure higher standard of judges.
