Bakalaura darba temats „Zemesgrāmatu valsts nodevu principi” ir izvēlēts ar mērķi izpētīt tādas valsts nodevas tiesisko regulējumu, kas iekasējama par pirkuma ceļā iegūta nekustamā īpašuma tiesību nostiprināšanu zemesgrāmatā. Darbā apskatīts nodevas tiesību normu saturs, piemērošanas kārtība, fiskālā un sociālā ietekme. Tiek pētīta nodevas izcelsme un pielietojums citu valstu tiesību sistēmās salīdzinājumā ar Latvijas vēsturisko un aktuālo regulējumu, kā arī pārbaudīta nodevas likmes un bāzes atbilstība apliekamā notikuma būtībai. Darbā tiek izvirzīta tēze, ka nodevas patiesā jēga nav atlīdzība par valsts nodrošināto īpašuma tiesību nostiprināšanas pakalpojumu, bet gan nekustamā īpašuma pirkuma darījuma taksēšana ar fiskālu mērķi. Tādējādi izdarāms secinājums, ka nodeva ir īpašuma pārejas nodoklis. Efektīvākai valsts mērķu sasniegšanai nodevas regulējums ir grozāms, vienlaicīgi pienācīgi nodrošinot indivīdu cieņu, tiesības un nodokļu piemērošanas taisnīgumu. Atlīdzība par administratīvo nostiprināšanas pakalpojumu ir atdalāma no darījumu apriti regulējoša nodokļa. Tiek izvērtēta nodevas esošā bāze un sniegta argumentācija uzskatam, ka nav ekonomiska un taisnīga pamata kadastrālās vērtības izmantošanai par nodevas bāzi. Tās vietā būtu taksējama tikai pirkuma darījuma patiesā vērtība. Papildus nodevas un nodokļa materiālo tiesību normu analizēšanai tiek veikta esošā un ierosinātā regulējuma kā pamattiesību ierobežojuma konstitucionālās atbilstības pārbaude. The topic of the bachelor’s thesis „The Principles of Determination of the Land Register Duties” has been selected to explore the legal framework of state duty chargeable for registration of real estate acquired by purchase. The thesis examines the content, application procedure, as well as fiscal and social impact of the state duty. The origin and application of the duty in other states is studied and compared to the Latvian historical and current legal framework, the compliance of the duty’s rate and basis to the nature of the chargeable event is tested. The thesis argues that the true purpose of the state duty is not consideration for the state provided service of entering the property rights, but rather taxing the conveyance of real estate with a fiscal purpose. Thus, it can be concluded that the duty is a transfer tax. To effectively achieve national goals while ensuring the dignity and rights of individuals and fairness of taxation, the regulation of the duty should be amended. The consideration for the administrative service of registration should be separated from the tax which regulates the movement of transactions. The existing basis of the duty is evaluated, and argumentation provided that there are no economical and fair grounds for use of cadastral value as the basis of the duty. Instead, only the fair value of the purchase transaction should be taxed. In addition to the analysis of duty and tax substantial law, the constitutional conformity of the current and proposed regulation as a restriction of fundamental rights is reviewed.
