Darbā analizēts invaliditātes tiesiskais regulējums Latvijas Republikā, invaliditātes medicīniskais, sociālais un cilvēktiesību modelis, procedūras, kā tiek noteikta invaliditāte, un informācija par sociāli atbildīgas valsts principa īstenošanu praksē. Teorētiskajā daļā ietverts vispārīgs ieskats invaliditātes jēdziena definīcijās, kas atrodamas Latvijas normatīvo aktu regulējumā, starptautisko tiesu judikatūrā, kā arī starptautiskajos normatīvajos aktos. Papildus teorētiskajā daļā ietverts ieskats par invaliditātes medicīnisko, sociālo un cilvēktiesību modeli. Definīciju skaidrošana ir nepieciešama, lai izprastu invaliditātes jēdziena attīstību Latvijā. Darba praktiskajā daļā tiek pētīta invaliditātes noteikšanas procedūra no iesnieguma iesniegšanas Veselības darbspēju ekspertīzes ārstu komisijā līdz lēmuma apstrīdēšanas procedūrai tiesā. Šajā daļā tiek analizēta faktiskā pieejamība invaliditātes noteikšanas procedūrai, kā arī izsvērti jautājumi par invaliditātes noteikšanu uz konkrētu termiņu un meklēti risinājumi ar to saistītajām problēmām. Papildus praktiskajā daļā tiek pētīts sociāli atbildīgas valsts princips kopsakarā ar problēmjautājumiem invaliditātes noteikšanā un Konvencijas par personu ar invaliditāti tiesībām īstenošanu Latvijas Republikā. This thesis analyses the legislation of disability in the Republic of Latvia: the medical, social and human rights model of disability, the procedures determining whether a person is a disabled person,, and the information about the praxis of the principle of a socially responsible country. The theoretical part delivers a general overview on the definitions of disability that can be found in the laws and regulations of Latvia, international case law, and international laws and regulations. The theoretical part also provides an insight about the medical, social and human rights model of disability. Discussions on definitions are crucial for the understanding of the development of the concept of disability in Latvia. The practical part delivers a research on the procedure of claiming disability status starting from submitting an application to the doctor experts of the State Commission, ending with the appellation of decision in court. This part analyses the actual accessibility of determination of disability procedure, addresses questions on prescribing disability for a specific term, and searches for solutions to the problems associated with this procedure. In addition, this part researches the principle of a socially responsible country in relation to the problematic questions regarding the procedures determining whether a person is a disabled person in conjunction with the implementation of the Convention on the Rights of Persons with Disabilities in the Republic of Latvia.
