Aizdomās turētā pratināšanas taktiskie paņēmieni

Abstract

Darbā ir pētītas un analizētas aizdomās turētā pratināšanas taktikas īpatnības un problēmas, analizēti Latvijas un ārvalstu speciālistu viedokļi, apskatīta Latvijas un ārvalstu tiesu un izmeklēšanas prakse. Darba uzdevums bija izpētīt aizdomās turētā pratināšanas kriminālistiskās taktikas un ar to saistītās praktiskās problēmas un kļūdas Latvijā un ārvalstīs, izstādāt rekomendācijas, kuras ļauj izvairīties no tām. Darbā izpētītas tipiskās izmeklēšanas situācijas un izstrādātas to risināšanas vadlīnijas. Sakarā ar to, ka nav iespējams apskatīt aizdomās turētā pratināšanas taktikas īpatnības atrauti no kriminālprocesuālajam īpatnībām, darbā arī ir izpētītas aizdomās turētā pratināšanas procesuālās grūtības un to risināšanas veidi, tajā skaitā, arī pielietojot taktiskos paņēmienus. Darbā arī ir izpētītas atsevišķu pratināšanas veidu īpatnības, piemēram, pratināšana aizstāvja klātbūtnē un poligrāfa izmantošana aizdomas turētā pratināšanā.

This research is dedicated to the analysis of detainee interrogation process, its tactical features, as well as various challenges resulting the different approaches. In order to analyse the issue in the most objective way, the following sources of information were examined: opinions of the acknowledged legal scholars and law enforcement officers from Latvia and abroad, both Latvian and foreign case law and interrogation practices. The aim of this research was to explore Latvian and foreign methods of forensic science that apply during the suspect interrogation, common mistakes and practical problems that come along the process, as well as develop a set of recommendations that will allow to avoid them. There will be examined the most typical practical situations and developed solution guidelines. Taking into account that it is impossible to consider tactical features of the detainee interrogation in an isolation from the features of criminal procedure, this work also encompasses procedural difficulties related to the interrogation and ways to solve them, also with the help of criminalistics techniques. Additionally, this research looks at the particular interrogation features, such as presence of suspect's lawyer and use of polygraph during the interrogation process.
