Abstract

Dalītā īpašuma tiesisko attiecību problemātika ir daļa no Latvijas unikālās tiesību sistēmas, kur viens no būtiskākajiem un praksē neskaidrību raisošiem problēmjautājumiem ir piespiedu zemes nomas maksas apmēra noteikšana. Darba mērķis ir identificēt piespiedu zemes nomas maksas apmēra noteikšanas mehānisma problēmas un ierosināt turpmākai rīcībai nepieciešamās darbības taisnīga regulējuma izstrādei piespiedu nomas attiecībās. Pētījuma rezultātā noskaidrots, ka par atsevišķiem piespiedu zemes nomas maksas apmēra noteikšanas kritērijiem joprojām nav izveidojusies vienveidīga tiesu prakse, kas liecina par normatīvā regulējuma deficītu šajā jomā. Līdz ar to Latvijā ir nepieciešams pilnveidot pašreizējo regulējumu, lai nodrošinātu tiesisku, stabilu un efektīvu mehānismu piespiedu zemes nomas masas apmēra noteikšanai ņemot vērā arī nepieciešamību pakāpeniski atkāpties no šī institūta.

The problem of legal relations of the shared property is a part of the unique legal system in Latvia. One of the most important and practical issues of uncertainty arises In this regard is the determination of the amount of compulsory land rent. The aim of the work is to identify the problems of the mechanism for determining the amount of compulsory land lease payments and to propose the actions necessary for further action to develop a fair regulation of forced lease relations. The result of the research clarified that unified criteria for the determination of the amount of compulsory land lease have not been established yet. That indicates a regulatory deficit in this area. In order to ensure a legal, stable and effective mechanism for determining the amount of land lease it is necessary to improve the current regulation in Latvia taking into account the need for a gradual leaving from this institution later.
