Valsts galvas aizstāšanas institūts Latvijā un ārvalstīs

Abstract

Maģistra darba temats “Valsts galvas aizstāšanas institūts Latvijā un ārvalstīs” ir aktuāls tamdēļ, ka Latvijas Republikas Satversmē ir norādīti tikai Valsts prezidenta aizstāšanas gadījumi un norādīts Valsts prezidenta aizstājējs – Saeimas priekšsēdētājs. Taču par to, cik plašas ir aizstājēja pilnvaras un kāda ir turpmākā aizstāšanas secība, gadījumā, ja arī Saeimas priekšsēdētājs nespētu izpildīt Valsts prezidenta amatu, nav noteikts. Darba mērķis ir izpētīt Latvijas un citu valstu normatīvajos aktos ietverto regulējumu attiecībā uz Valsts prezidenta aizstāšanu un tā piemērošanas praksi. Darbs sastāv no trim nodaļām. Pirmajā nodaļā ir apskatīta Latvijas Valsts galvas institūta ģenēze, ievēlēšana un pilnvaras. Otrajā nodaļā ir apskatīti Valsts galvas aizstāšanas gadījumi Latvijā un ārvalstīs. Trešajā nodaļā ir analizēts Valsts galvas aizstājēja institūts Latvijā un citās Eiropas Savienības dalībvalstīs, kā arī tiek pētīts aizvietotāju pilnvaru apjoms aizstājot valsts galvu. Darba ietvaros apskatīti Satversmes 52. pantā norādītie Latvijas Valsts galvas aizstāšanas gadījumi kā arī ārvalstu konstitūciju regulējumi un prakse attiecībā uz Valsts galvas aizstāšanu. Līdz ar to, darbā ir sniegti vairāki priekšlikumi, lai pilnveidotu Latvijas Valsts prezidenta aizstāšanas institūtu. Darba apjoms ir 89 lapas. Darbā izmantoti 136 avoti. The theme of the Master's thesis "Substitution for the State president in Latvia and abroad" is topical because in the Constitution of Latvia there are indicated only cases of substitution for the Head of State and a substitute for the Head of State – Chairperson of the Saeima. However, there is not specified the information how broad the powers of the substitute are and what further substitution, if Chairperson of the Saeima cannot fullfill the position of President of Latvia, it sequence is. The aim of the thesis is to examine the regulation of Latvia and other states in relation to the substitution for the State president, and its application in practice. The thesis consists of three chapters. The first chapter considers a genesis, election and powers of the Head of State of Latvia. The second chapter examines the cases of substitution for the Head of State in Latvia and abroad. The third chapter analyzes with the substitutes for the Head of State in Latvia and other European Union countries, as well as amount of their powers, substituting for the Head of State. During development of the thesis there were considered the cases of substitution for the Head of State of Latvia identified in the Article 52 of the Constitution of Latvia, as well as foreign constitution regulations and practice in relation to the substitution for the Head of State. Hence, the thesis provides several proposals to improve the substitution for the Head of State of Latvia. Workload is 89 pages. 136 sources were used in the work.
