Tiesnesis ir likuma un taisnīguma sargs. Tiesiskā un demokrātiskā sabiedrībā ir svarīgi, lai tiesneši ir objektīvi, neitrāli, jo tas palielina sabiedrības uzticību tiesu varai. Tiesnesim, izskatot konkrētu lietu, ir jābalstās uz objektīviem kritērijiem kā pušu iesniegtajiem pierādījumiem, liecībām, nevis uz personiskiem aizspriedumiem. Ja tiesnesim ir personiski aizspriedumi, tad viņam ir jāatstata sevi no lietas izskatīšanas vai arī lietā iesaistītās puses var pieteikt tiesnesim noraidījumu. Bakalaura darba mērķis ir izpētīt kā atstatīšanās un noraidīšanas institūts tiesnešiem spēj nodrošināt objektīvu un neitrālu tiesu. Darba ietvaros autore analizēja jēdzienu “objektivitāte” un “neitralitāte” skaidrojumu tiesību un ētikas normās, tiesnešiem noteiktos ierobežojumus un procesuālās garantijas, lai garantētu to, ka lietas izskatīšanā tiesneši būtu objektīvi, neitrāli, kā arī atstatīšanās un noraidīšanas institūta būtību. Atstatīšanās un noraidīšanas institūta regulējumu Civilprocesā, Kriminālprocesā, Administratīvajā procesā, lai spētu saskatīt kopīgās un atšķirīgās pazīmes. Darba izstrādes gaitā autore nonāk pie atziņas, ka Latvijas tiesību un ētikas normās jēdziens “neitralitāte” nav minēts, tiek lietots tikai jēdziens “objektivitāte”. Šie jēdzieni uzskatāmi par sinonīmiem. Atstatīšanās un noraidīšanas institūta būtība ir nodrošināt, ka lietas izskatīšanā piedalās tikai objektīvi tiesneši. The judge is the guard of law and justice. In judicial and democratic society, it is important for judge to be objective and neutral, because it increases societies trust in the power of the courts. The judge while examining a given case, must rely on given evidence and testimony by both parties, not on personal prejudice. If the judge has personal prejudice, he must disengage himself from the case if this does not happen both parties can request for the judge to be dismissed from the case. The aim of the bachelor theses is to research how disengagement and dismissal institutions for judges can enable objective and neutral court. Within the range of bachelor theses, the author analyses concept of “objectivity” and “neutrality” meaning in norms of rights and ethics, defined limits and procedural guaranties for judges to guarantee that while examining the case judges would be objective and neutral and also disengagement and dismissal institution essence. Disengagement and dismissal institution regulation in Civil proceedings, Criminal proceedings, Administrative proceedings, to be able to see the related and unrelated indications. In the course of the working process, author comes to realization, that concept of “neutrality” is not mentioned in Latvian rights and ethics norms, only the concept “objectivity” is used. These concepts are considered as synonyms. The meaning of disengagement and dismissal institute is to provide, that only objective judges may take part in examination of the case.
