Pašvaldību tiesības izdot informatīvos izdevumus

Abstract

Bakalaura darba mērķis ir noskaidrot, kāds ir Latvijas Republikas pašvaldību tiesiskais pamats informatīvo izdevumu izdošanai un, vai pastāv juridiski ierobežojumi attiecībā uz šādu izdevumu saturu. Attiecīgais jautājums juridiskajā literatūrā līdz šim nav pētīts, taču tā aktualitāti apstiprina gan tiesu prakse, gan pieņemtie normatīvo aktu grozījumi, kā arī grozījumu izstrādē esošie likumprojekti. Darba izstrādes procesā autore secināja, ka pašvaldībai kā valsts pārvaldes sastāvdaļai ir pienākums informēt sabiedrību par savu darbību, taču tas, kā šo pienākumu realizēt, ir katras pašvaldības indivudāla izvēle. Ja šis pienākums tiek realizēts ar informatīvo izdevumu palīdzību, pašvaldība veicina demokrātiskas diskursa telpas pastāvēšanu tikai tad, ja tā ar savām darbībām neatstāj negatīvu ietekmi uz citiem diskursa telpas veidotājiem un adresātiem.

The aim of the Bachelor thesis is to determine what the legal basis for the issue of the informational materials of the local governments of the Republic of Latvia is and find out if there are content-related legal restrictions. This issue has not been examined in the legal literature but the relevance of it has been confirmed by the court practice, the adopted amendments and the draft amendments of the draft laws. One of the main conclusions is that the local government, as an integral part of public administration, has a duty to inform the public about its activities, however, the execution of this obligation is determined by each local government itself. If this obligation is executed through the informative issues of local government, the local government promotes the existence of the democratic discourse only if it does not adversely affect other actors and recipients of the democratic discourse
