Noziedzīgu nodarījumu ceļu satiksmē krimināltiesiskā izpēte

Abstract

Valsts policijas statistikas dati liecina, ka noziedzīgu nodarījumu un ceļu satiksmes negadījumos cietušo skaits ceļu satiksmē ir palielinājies. Tas raksturojams ar pieaugošo transportlīdzekļu skaitu. Arī noziedzīgi nodarījumi, kas izdarīti transportlīdzekļa vadītājam atrodoties alkohola, narkotisko, psihotropo, toksisko vai citu apreibinošo vielu ietekmē arvien nesamazinās. Bakalaura darba tēma ir „Noziedzīgu nodarījumu ceļu satiksmē krimināltiesiskā izpēte”. Bakalaura darbā ir pētītas un analizētas aktuālākās problēmas, kas saistītas ar noziedzīgiem nodarījumiem ceļu satiksmē krimināllikuma 260. un 262.panta ietvaros. Darbā sīkāk tiek pētīti noziedzīgi nodarījumi, kas saistīti ar ceļu satiksmes negadījumiem un transportlīdzekļa vadīšanu reibumā, bez noteiktā kārtā iegūtām transportlīdzekļa vadīšanas tiesībām, jo šie ir izplatītākie un nodarījumi pret satiksmes drošību. Bakalaura darbs sastāv no trīs nodaļām. Pirmajā nodaļā tiek analizēts ceļu satiksmes noteikumu vispārīgais raksturojums. Otrajā nodaļā tiek analizēts šajos pantos paredzētā noziedzīgā nodarījuma sastāvs – objekts, objektīvā puse, subjekts, subjektīvā puse. Trešajā nodaļā tiek analizēti noziedzīgi nodarījumi ceļu satiksmē, kas paredzēti Krimināllikuma 260. un 262.pantā. Bakalaura darba katras nodaļas un apakšnodaļas beigās tiek noformulēti secinājumi, bet darba beigās tiek apkopoti secinājumi par izvēlētās tēmas pamatproblēmām, kā arī tiek piedāvāti šo pamatproblēmu iespējamie risinājumi. Bakalaura darba izstrādes gaitā tika analizēti dažādi materiāli, literatūra, tiesu prakse un citi materiāli. The statistics of the State Police show that the number of victims of criminal offenses and road traffic accidents has increased in road traffic. It is characterized by an increasing number of vehicles. Also, criminal offenses committed by a driver under the influence of alcohol, narcotic, psychotropic, toxic or other intoxicating substances are not decreasing. The subject of the Bachelor's paper is "Crime Investigation of Offenses in Road Traffic". Bachelor's thesis explores and analyzes topical issues related to criminal offenses in road traffic within the framework of Articles 260 and 262 of the Criminal Law. The thesis deals with criminal offenses related to road traffic accidents and in-vehicle driving, with no definite driving licenses, as these are the most common and traffic-related offenses. The Bachelor Thesis consists of three chapters. The first chapter analyzes the general characteristics of road traffic regulations. The second chapter analyzes the composition of the offense envisaged in these articles - an object, an objective party, a subject, a subjective party. The third chapter analyzes criminal offenses in road traffic provided for in Articles 260 and 262 of the Criminal Law. At the end of each chapter and subdivision of the bachelor's paper conclusions are formulated, but at the end of the work conclusions of the basic problems of the chosen topic are summarized, as well as possible solutions of these basic problems are offered. During the development of the Bachelor's paper, various materials, literature, case law and other materials were analyzed.
