Abstract

Kratīšana ir galējs izmeklēšanas līdzeklis, kura pielietošana nevietā var būtiski aizskart personas un dzīvokļa neaizskaramības konstitucionālās garantijas, tieši tāpēc nepieciešams ievērot atbilstošus taktiskos paņēmienus, lai, pirmkārt, iegūt vērtīgus un pat izšķirīgus pierādījumus noziedzīgu nodarījumu atklāšanai un, otrkārt, sasniegtu kratīšanas mērķi – atrast un izņemt objektus, kam nozīme krimināllietā. Lai sasniegtu darbā izvirzītos mērķus, darba autore analizē taktiskos paņēmienus katrā telpu kratīšanas stadijā, pēta tiesu praksi un veic aptauju. Darba izstrādes laikā autore secina, ka taktiskais paņēmiens ir neatņemams telpu kratīšanas elements, un tā būtība atklājas izmeklēšanas darbības sekmēšanā.

Search is the ultimate investigation tool whose misuse can seriously harm the constitutional guarantees of the person and the inviolability of the living premises, precisely for this reason it is necessary to follow appropriate tactical methods, firstly, to obtain valuable and even decisive evidence for the detection of criminal offenses and, secondly, to achieve the purpose of the search - to find and remove evidences that matter in a criminal case. In order to achieve the goals set in the work, the author analyses tactical techniques at each stage of the search for premises, examines case law and conducts a survey. During the development of the research, the author concludes that the tactical technique is an integral part of the search for premises, and its essence is revealed in facilitating investigative activities.
