ANO Statūtu 51. pants- valsts prakse un problemātika

Abstract

Bakalaura darba tēmu, “ANO Statūtu 51. pants – valstu prakse un problemātika”, autors izvēlējās, jo ANO Statūtu līgums ir vēsturiski veiksmīgākais starptautiskais miera uzturēšanas līgums. Tāpēc autors kā darba mērķi uzņēmās izpētīt, ar kādiem šķēršļiem ANO saskārās tā darbības laikā, attiecībā uz vienu no diskutētākajiem starptautisko tiesību principiem – pašaizsardzības principu. Darbā vispirms tiek pētīta starptautisko tiesību vēsturiskā attīstība, attiecībā uz atteikšanos no kara jēdziena lietošanas, kā arī tiesu prakse bruņota spēka pielietošanas jēdziena definēšanā. Taču darba galvenais uzdevums bija analizēt pašaizsardzības principa attīstību ANO pastāvēšanas laikā, iekļaujot dalībvalstu centienus paplašināt jēdziena tvērumu ar jaunām doktrīnām, piemēram, humanitārā intervence un pilsoņu aizsardzība ārvalstīs.

Author of the Bachelor’s (LL.B) paper “51st article of the UN Charter – state practice and problems” chose this topic because UN Charter as an international treaty has been without a doubt the most successful one. As for purpose of the work, author explores the obstacles that the UN had to face while applying one of the most controversial principles of international law – right to self-defense. First, author analyzes historical aspects in creation of the UN Charter, as well as explores problems that ICJ had to face while applying rules of the Charter. Then, author analyzes the principle of self-defense under customary as well as treaty law. Author also explores the different variations of state practice under the article 51 of the Charter, for example humanitarian intervention and protection of nationals abroad.
