Mūsdienās viena no neatņemamām demokrātiskas un tiesiskas valsts tiesiskās sistēmas sastāvdaļām ir vispārējie tiesību principi. Tā kā vispārējie tiesību principi visi ir vienlīdz juridiski nozīmīgi, nevar izvairīties no situācijas, kad tiesību normu piemērotājiem rodas jautājums – kā taisnīgi, precīzi un juridiski korekti izšķirt strīdu tur, kur savstarpēji kolidē vienlīdz juridiski nozīmīgi vispārējie - tiesiskuma un likuma ievērošanas – tiesību principi. Darbā apkopoti dažādu valsts tiesību doktrīnu un tiesību zinātnieku atziņas attiecībā uz darbā apskatāmo principu saturu un to vietu demokrātiskas valsts tiesiskajā sistēmā, kā arī vispārējo tiesību principu kolīzijas risināšanas metodes. Pētījuma rezultātā atklājusies Administratīvā procesa likuma 15.panta vienpadsmitās daļas nepiemērojamība, ko darba autore ierosina izslēgt no normatīvā regulējuma. Nowadays, one of the basic elements of a state of Democracy and the Rule of Law legal system is General Principles of Law. Since all of the general principles of law have equal legal significance, law enforcement agents are facing problems with achieving the most useful, just and equitable result in the specific case, where a conflict between two general principles of law - The Rule of Law and the principle of compliance with the law – arises. The study summarizes the legal doctrines of The Rule of Law and Rechtsstaat principles and legal scholars’ opinions regarding the problems of the collision of general principles, including the description of legal methods for resolving conflicts between two general principles of law. As a result of the study, the inapplicability of the Section 15, Paragraph 11 of the Administrative Procedure Law has been revealed; therefore the author proposes to exclude the regulation referred to above from the regulatory framework.
