Pēdējos gados strauji pieaug ar finanšu sektoru nesaistītu personu skaits, kurām ar likumu tiek uzlikts pienākums izvērtēt savai darbībai un klientiem piemītošos noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas riskus, iecelt par noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas novēršanas prasību izpildi atbildīgos darbiniekus un izstrādāt konstatēto risku pārvaldīšanas iekšējās kontroles sistēmu. Šie un citi pienākumi izriet no Noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas novēršanas likuma. Šī pētījuma gaitā autors analizējis iekšējās kontroles sistēmas jēdzienu, par noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas novēršanas prasību izpildi atbildīgo darbinieku apmācību procesuālo regulējumu, noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas riska kategorijas, kā arī nesen apstiprināto sankciju regulējumu. Pētījuma rezultātā autors konstatējis trūkumus Noziedzīgi iegūtu līdzekļu legalizācijas un terorisma finansēšanas novēršanas likumā nostiprinātajā iekšējās kontroles sistēmas izveidošanas un atbildīgo darbinieku apmācību nodrošināšanas tiesiskajā regulējumā un piedāvājis regulējuma uzlabojumus. In recent years, there has been a rapid increase in the number of actors representing non-financial sector that are required by law to assess money laundering and terrorism financing risks inherent for their activities and customers, to appoint employees responsible for the fulfilment of the requirements for the prevention of money laundering and terrorism financing and to develop an internal control system for the management of identified risks. These and other obligations arise from the Law on the Prevention of Money Laundering and Terrorism Financing. In the course of this study, the author analysed the concept of an internal control system, the procedural framework for training of employees responsible for the fulfilment of the requirements for the prevention of money laundering and terrorism financing, risk categories of money laundering and terrorism financing as well as newly adopted sanctions regulation. As the result of this study, the author has identified deficiencies in the legal framework for creation of internal control system and the provision of training for responsible employees as stipulated in the Law on Prevention of Laundering and Terrorism Financing and offered regulatory improvements.
