Trešo personu finansējuma ietekme uz šķīrējtiesnešu objektivitāti un neatkarību starptautiskajā šķīrējtiesas procesā

Abstract

Arvien lielāku nozīmi starptautiskajā šķīrējtiesu procesā gūst jautājums par trešo personu finansējuma izmantošanu un tā ietekmi uz procesa tiesiskumu un godīgumu. Tā kā finansējuma ņēmēja iespēja uzsākt šķīrējtiesas procesu ir atkarīga no tiesvedības izdevumu samaksas, strīda finansētājs ir spējīgs uzstādīt savus nosacījumus un ietekmēt personas lēmumus procesa ietvaros. Taču tas aktualizē jautājumu, vai šāda ietekme var skart arī lietā ieceltos šķīrējtiesnešus. Darbā tiek pētīts trešo personu finansējums un tā regulējums šķīrējtiesas procesa ietvaros un kādu ietekmi tas rada uz šķīrējtiesas procesa dalībniekiem, un pats svarīgākais – uz šķīrējtiesnešu objektivitāti un neatkarību, konstatējot divus galvenos ietekmes veidus un piedāvājot iespējamus risinājumus, kā šo ietekmi mazināt.

The use of third party funding as well as questions regarding its possible influence on legality and integrity of arbitration proceedings are becoming more relevant. The possibility of person to initiate arbitration is dependent on whether the arbitration fees are covered, which allows for the third party funder to set conditions for funding as well as exercise influence on the decisions made by person within the arbitration proceedings. However, this raises a question whether such influence may be exercised also on arbitrators appointed in arbitral tribunal. This thesis addresses third party funding and regulation of thereof in arbitration as well as the influence of third party funding on the parties of arbitration and more importantly – on impartiality and independence of arbitrators. Thesis discovers two main ways of influence as well as offers possible solutions in order to minimize them.
