Darbā pētīta tiesu neatkarība no likumdevēja un izpildvaras, par problemātisko aspektu izvirzot likumdevēja un izpildvaras ietekmi tiesneša iecelšanas, apstiprināšanas procesā un tiesneša tālākās karjeras virzībā. Darba mērķis ir konstatēt un izvērtēt līdzšinējā tiesiskā regulējuma teorētiskos un faktiskos apdraudējumus tiesu neatkarībai, tiesnešu ietekmēšanai, un secināt, vai spēkā stājušās likuma izmaiņas šo apdraudējumu mazina. Darbā izvirzīti uzdevumi pētīt tiesneša nozīmi demokrātiskā sabiedrībā, amata prasības, analizēt tiesneša iecelšanas, apstiprināšanas amatā un pārcelšanas citā tiesā līdzšinējā un jaunā tiesiskā regulējuma problemātiku, riskus tiesu neatkarībai Latvijā, salīdzināt praksi ārvalstīs. Darbā secināts, ka ar jaunākajiem grozījumiem likumā pilnībā nav novērsti darbā konstatētie un analizētie tiesu varas neatkarības iespējamie apdraudējumi. Pētījuma rezultātā autors izvirza priekšlikumu nodot pilnvaras Tieslietu padomei arī jautājumā par tiesneša apstiprināšanu amatā pēc t.s. pārbaudes laika beigām, savukārt Saeimas un tieslietu ministra pilnvaras šajā procesā attiecīgi ierobežot. This thesis examines the independence of the judiciary from the legislator and the executive branch, placing the legislator and the executive power on the problematic aspect in the process of appointing, approving judge and career of judge. The aim of the work is to identify and evaluate the theoretical and actual threats to the independence of courts, influence of judges, and to conclude whether the changes in the law have changed the threat. The tasks set out are to study the role of a judge in a democratic society, requirements of the position, analyze current and new legal regulation’s problematic aspects of the appointment, approval and transfer of judge to another court, the risks to the independence of the courts in Latvia, and compare the practice abroad. This work concluded that the latest amendments to the law did not completely eliminate the possible threats to the independence of the judiciary identified and analyzed at the work. As a result of the study, the author proposes to transfer the powers to the Council of Justice on the issue of the approval of a judge after the end of the probationary period, while the powers of the parliament and the Minister of Justice in this process should be limited accordingly.
