Tiesnešu apstiprināšana uz mūžu kā neatkarības garantija Latvijas Republikā

Abstract

Ramona Karīna Hmeļņicka. Bakalaura darbs par tiesnešu apstiprināšanu uz mūžu kā neatkarības garantiju Latvijas Republikā. Darba vadītājs: Dr.iur., prof. Sanita Osipova, Rīgā, 2018. Cilvēka tiesību efektīva īstenošana nav iespējama, ja tiesneši nav neatkarīgi. Tiesu varas neatkarība tiek nodrošināta ar tiesnešu neatkarības garantiju ievērošanu. Viena no šādām garantijām ir tiesneša apstiprināšana uz mūžu. Vairāki Latvijas zinātnieki ir pētījuši tiesu varas neatkarības garantijas, taču neviens no autoriem nav padziļināti pētījis tiesnešu apstiprināšanu uz mūžu kā tiesneša neatkarības garantiju. Tāpēc autore ir veltījusi pētījumu tieši šīs tiesnešu neatkarības garantijas daudzpusīgai izpētei. Darbā izvirzītais mērķis ir izpētīt, vai Latvijas teritorijā XX gs. tiesnešu pilnvaru termiņš tika mainīts atbilstoši politiskajam režīmam, un analizēt, vai ar tiesneša apstiprināšanu uz mūžu tiek nodrošināta tiesu varas neatkarība. Darbā tiek izpētīts tiesnešu pilnvaru termiņš un tā apstiprināšanas kārtība Latvijas teritorijā starpkaru periodā, pēc atkārtotās padomju okupācijas un pēc Latvijas neatkarības atjaunošanas. Darbā netiek pētīts viss atkārtotās padomju okupācijas laiks, bet tikai totalitārā režīma periods 1945.-1952. gados, jo pilns otrās padomju okupācijas periods ir atsevišķa pētījuma vērts. Autore darbā secina, ka Latvijas teritorijā XX gs. tiesnešu pilnvaru termiņš tika mainīts atbilstoši politiskajam režīmam, proti, tas bija gan ierobežots, gan neierobežots. Autore secina, ka ar tiesneša apstiprināšanu uz mūžu tiek nodrošināta tiesu varas neatkarība. Darbs sastāv no 3 nodaļām, 7 apakšnodaļām, ievada un kopsavilkuma. Darbā izmantoti tādu autoru darbi, kā Aristotelis, Š. L. de Monteskjē, Dž. Loks u.c. The effective implementation of human rights is not possible if the judges are not independent. Independence of the judiciary is ensured by observance of the guarantees of independence of judges. One of such guarantees is the approval of a judge for life. Several Latvian scientists have studied the guarantees of the independence of the judiciary, but none of the authors have studied the approval of judges for life as a guarantee of the independence of judges in depth. Therefore, the author has devoted a bachelor thesis to a comprehensive study of this guarantees of independence of judges. The aim of this work is to investigate whether in the territory of Latvia in the 20th century the term of office of judges was changed according to the political regime and analyze whether the approval of judges for life ensures the judicial independence. The work examines the term of office of judges and their approval in the territory of Latvia during the interwar period, after the re-occupation of the Soviets and after the restoration of Latvia's independence. In this work is not investigated the entire period of the Soviet occupation, but only the period of totalitarian regime from year 1945 to 1952, because the whole period is a separate research worth. The author concludes that in the territory of Latvia in the 20th century the term of office of judges was changed according to the political regime, so, term has been both limited and unlimited. The author concludes that, the approval of judges for life ensures the judicial independence. The work consists of 3 chapters, 7 sub-chapters, introduction and summary.
