Noziedzīgi iegūtu līdzekļu legalizēšana- pastāvošās problēmas, iespējamie risinājumi

Abstract

Noziedzīgi iegūtu līdzekļu legalizēšana ir noziegums, kas paredzēts Krimināllikuma 195.pantā, papildus tam, šī nozieguma apkarošanai ir ticis pieņemts arī atsevišķs likums, tieši Noziedzīgi iegūtu līdzekļu legalizēšanas un terorisma finansēšanas novēršanas likums. Neskatoties uz to, ka šo vienu noziegumu regulē ļoti plašs un izvērsts regulējums, tā apkarošana gan Latvijā, gan pasaulē ir bijusi ļoti neefektīva visā tā pastāvēšanas laikā. Tieši tāpēc šī Bakalaura darba mērķis ir noteikt problēmas kādas pastāv atklājot, izmeklējot un notiesājot personas noziedzīgi iegūtu līdzekļu legalizēšanas gadījumos, lai pēc tam varētu piedāvāt konkrētus risinājumus šo problēmu turpmākai novēršanai. Lai sasniegtu darba mērķus tika izpētīts noziedzīgi iegūtu līdzekļu legalizēšanas kā noziedzīga nodarījuma sastāvs un būtība. Tālāk tika veikta atbildīgo iestāžu sniegtās informācijas un statistikas izpēte kā arī tika apskatīta tiesu prakse iepriekšējā laika periodā un tika analizēti pieņemtie tiesu nolēmumi noziedzīgi iegūtu līdzekļu legalizēšanas lietās laika posmā pēc tiesu prakses apkopojuma tapšanas. Visbeidzot, tika apskatīts Latvijas Republikas novērtējums starptautiskajās organizācijās, kuras atbild par noziedzīgu iegūtu līdzekļu legalizēšanas apkarošanu. Darba rezultātā autors ir nonācis pie secinājumiem par noziedzīgi iegūtu līdzekļu legalizēšanas kā nozieguma būtību, atklājis dažādas problēmas kādas pastāv pašreizējā regulējumā un sekojoši piedāvājis konkrētus risinājumus šo problēmu novēršanai.

Money laundering is a crime that's defined in Section 195 of Latvian Criminal law. Furthermore there is a separate law that has been legislated for the purpose of fighting against money laundering. Nonetheless, even with these detailed and saturated regulations there exists a general consensus that the fight against money laundering has been and still is very ineffective both in Latvia and the rest of the world as well. That is the reason why the sole purpose of this Bachelor's thesis is to find the problems that currently exist in relation to money laundering as a crime and to give solutions to these existing problems in the Latvian legal system. To achieve this goal there was research done on money laundering as crime, it's theoretical aspects and it's essence. Furthermore the research was also done by compiling and analysing statistics given by authorities which are involved in detecting and prosecuting money laundering, as well as analysing jurisprudence and cases that have happened most recently. Finally there was research done on the international aspects of money laundering, to be more precise, in relation to Latvia's results in the fight against money laundering evaluated by corresponding international organizations, for the purpose of understating the problems that were overlooked in previous parts of this thesis. As a result the author of this work has come to some conclusions on the nature of money laundering as a crime and many problems related to the existing legislation have been revealed. For that reason appropriate solutions have been offered to rectify the existing problems.
