Drošības nauda kā drošības līdzeklis

Abstract

Drošības nauda kā drošības līdzeklis ir sens tiesību instruments, kas nodrošina normālu kriminālprocesa mērķu sasniegšanu gadījumos, kad persona rīkojas neatbilstoši kriminālprocesa izmeklēšanas un tiesvedības interesēm, un neievēro tai ar likumu uzliktos pienākumus. Lai gan drošības nauda kriminālprocesā lielākoties piemērota kā apcietinājuma alternatīva, praksē tā vērtējama kā efektīvs drošības līdzeklis. Praksē, galvenokārt, problemātika iezīmējas drošības naudas piemērošanā, proti, apmēra noteikšanā, kā arī juridisko seku izskaidrošanā drošības naudas iemaksātājam. Tāpat arī Kriminālprocesa likumā noteiktā pienākuma par rakstveida paziņojuma par iemaksātās naudas izcelsmi iesniegšanas nepieciešamību un efektivitāti. Darba mērķis ir izprast drošības līdzekļa - drošības naudas - apmēra noteikšanas, izcelsmes, piemērošanas kārtības un tās nosacījumu neievērošanas seku problēmjautājumus, un rast uz tiem loģiskus, efektīgus risinājumus. Bakalaura darbs izstrādāts balstoties uz juridiskās prakses materiāliem, tiesību doktrīnā paustajām atziņām, juridisko literatūru, publikācijām, Latvijas Republikas un ārvalstu normatīvajiem aktiem, kā arī apkopotajiem statistikas datiem par apcietinājuma aizstāšanas ar drošības naudu reizēm 2016. un 2017.gadā. Darba izstrādes rezultātā izdarīti secinājumi par drošības naudas piemērošanu gan no teorētiskās, gan praktiskās puses, kā arī izteikti priekšlikumi esošo problēmu un normatīvā regulējuma pilnveidošanai. The security deposit as a security tool is an ancient legal tool that ensures the normal pursuit of criminal proceedings in cases where a person acts in an inappropriate interest in criminal proceedings and legal proceedings and does not comply with statutory obligations. Although security deposit in the criminal proceedings is generally used as an alternative to detention, in practice it is considered an effective security tool. In practice, the problem is mainly in the application of security deposit, namely in determining the amount, as well as in explaining the legal consequences to the depositor of the security deposit. Similarly, the necessity and effectiveness of the obligation of the Criminal Procedure Law for the submission of a written statement on the origin of the money paid. The aim of the work is to understand the problems of determining the security tool - security deposit - amount, origin, the procedure for applying it and the consequences of non-compliance with its conditions, and find logical and effective solutions to them. Baccalaureate work has been developed on the basis of legal practice materials, legal literature doctrine, legal literature, publications, laws of the Republic of Latvia and foreign countries, as well as aggregated statistical data on the replacement of detention with a security deposit in 2016 and 2017. As a result of the work, conclusions regarding the application of the security deposit from both the theoretical and practical aspects, as well as proposals for improving the existing problems and regulatory framework, have been made.
