Bakalaura darba temata “Vainas forma – neuzmanība - krimināltiesībās” būtība ir noziedzīga nodarījuma vainas formas noteikšana saliktā sastāvā, kas mūsdienās ir joprojām problēma Latvijas regulējumā, skatoties uz faktu, ka Krimināllikumā nav neviena panta, kas regulētu šīs problēmas atrisināšanu praksē. Bakalaura darba mērķis ir izpētīt vainas formas - neuzmanības definīciju; analizēt neuzmanības noteikšanas problemātiku praksē; aplūkot neuzmanības regulējumu ārvalstīs, akcentējot kopīgo un atšķirīgo ar Latvijā noteikto; kā arī sniegt secinājumus un priekšlikumus neuzmanības noteikšanai praksē Latvijā saistībā ar saliktu sastāvu. Bakalaura darba uzdevumi: 1)izpētīt neuzmanības institūta vēsturisko attīstību; 2)salīdzināt citu valstu regulējumus ar Latvijas regulējumu; 3)meklēt un analizēt prakses piemērus par neuzmanības noteikšanu; 4)izvērtēt citu tiesību zinātnieku viedokļus par šo tēmu. Pēc bakalaura darba tēmas izpētīšanas darba autore izvirzīja secinājumus, kā arī ierosinājumus, kas varētu uzlabot neuzmanības noteikšanu praksē saistībā ar saliktu sastāviem. Bakalaura darbā ir zinātniski pētnieciskās metodes: 1) pētījuma metode, kas tiks pielietota pētot neuzmanības institūta vēsturisko attīstību; 2) aprakstošā metode, kas tiks izmantota aprakstot neuzmanību, noziedzīgo pašpaļāvību un noziedzīgo nevērību; 3) salīdzinošā metode, kas tiks pielietota salīdzinot Latvijas regulējumu ar citu valstu regulējumiem; 4) analītiskā metode, kas tiks izmantota analizējot šī bakalaura darba ietvaros izmantoto literatūru, avotus, praksi un normatīvos aktus. Bakalaura darba rezultātā tika izpētīts neuzmanības institūta vēsturiskā attīstība; vainas būtība Latvijā, neuzmanības jēdziens; būtība gan Latvijā, gan ārvalstīs; kā arī neuzmanības norobežošana no nodoma. The topic of this Bachelor’s thesis is “Form of guilt – negligence – in Criminal law”. The essence of this thesis is determining the form of guilt for crimes with complex structures, which is still a modern dilemma in Latvian criminal law, looking at the fact that in the Latvian Criminal Code there is no article that regulates this dilemmas solution in practice. The goal of this Bachelor’s thesis is to research the definition of negligence as the form of guilt; analyze the dilemmas in practice with determining negligence in practice; research criminal negligence from foreign country laws, emphasizing the similarities and the differences with Latvian criminal laws on negligence; as well as offer conclusions and proposals for determining negligence in crimes with complex structure in Latvian practice. The tasks of the Bachelor’s thesis are: 1)research the historical development of criminal negligence; 2)compare other country criminal codes and penal codes with the Latvian criminal code; 3)search and analyze practical examples about determining negligence; 4)research different law researcher opinions on this topic. After researching the topic of this Bachelor’s thesis the author of this thesis has made conclusions, as well as proposals, that could improve the determining of negligence in crimes with complex structures in practice. These scientific methods were used in this Bachelor’s thesis: 1) research method that will be used to research the historical development of criminal negligence; 2) descriptive method that will be used to describe negligence, criminal self-reliance, criminal neglect; 3) comparative method that will be used to compare Latvian criminal codes to other country criminal and penal codes; 4) analytical method that will be used to analyze literature, sources, practice and criminal and penal codes of this Bachelor’s thesis. In the results of the Bachelor’s thesis there will be finished researching on the historical development of criminal negligence; the essence of guilt and the definition of negligence in Latvia; the essence of negligence both in Latvia and in foreign countries; as well as delimitation between negligence and intent.
