Kriptovalūtas un to regulējums Eiropas Savienībā

Abstract

Līdz ar kriptovalūtas straujo attīstību pasaule un to šobrīdejo popolaritāti Eiropā, tās nelikumīgo izmantošanu, pieeaug kriptovalūtas negatīvā slava un Eiropas Savienības valstu negatīvā nostāja pret šādu, mums nepieņemamu, valūtas veidu, aizvien biežāk tiek sabiedrībā apspriests jautājums vai šādai valūtai nebūtu pienācis īstais laiks iegūt regulējumu, kas pēdējā gada laikā ir aktīvi apspriests arī no Eiropas Savienības valstu puses. Neskatoties uz to, ka jau kādu laiku šī valūta ir pastāvējusi, izpratne par to un kam tā ir radīta, ir ļoti maza. Eiropas Savienībai ir izstrādāts regulējums, kurš min kriptovalūtas, taču tas īsti tās neregulē. Tieši šī iemesla dēļ darba nosaukums ir “Kriptovalūtas un to regulējums Eiropas Savienībā”. Darba mērķis galvenokārt bija izprast, kas īsti ir kriptovalūta, kam tā ir pielietojama un kāpēc tā tika radīta, kāds ir tās mērķis, kā arī izpētīt ES dalībvalstu pausto viedokli par šādu valūtu un padziļināti izpētīt, uz doto brīdi, esošo regulējumu, kurš sevī ietver šo valūtas veidu. Lai sasniegtu darba mērķi, tika analizēti gan vietējie, gan starptautiskie normatīvie akti, interneta resursi, literatūra, tiesu prakse, viedokļi un citi avoti. Darba ietvaros autors noskaidroja, kriptovalūtas celšanās iemeslus, tās mērķus un plašo pielietojumu klāstu, kā arī negatīvos aspektus, kurus šāda valūta ness. Autors nebija domājis, ka tik ļoti ir nepieciešams regulējums, kriptovalūtai, un cik ļoti lielā apmērā tā ir pārņēmusi pasauli. Ņemot vērā kriptovalūtu inovitāti un to, ka zinātnisku pētijumu tieši no juridiskā viedokļa ir ļoti maz, autora prāt, svarīgākais ir sniegt skaidrojumu kriptovalūtu būtībai un rast pamatojumu tam, kāpēc šāds regulējums tik ļoti ir nepieciešams, kā arī izprast jau esošo regulējumu, tā saturu un virzību nākotnē.

With the rapid development of cryptocurrency, in the world and its popularity in Europe, its illegal use, increasing the negative reputation of cryptocurrency and the negative position of the European Union countries against it, unacceptable to us, currency type, it is increasingly being debated in the public, if it would be the right time for such a currency to get a regulation it has also been actively debated in the European Union for the last year. Despite the fact that this currency has existed for some time, the understanding of it and why it has been created is very small. The European Union has a framework that mentions cryptocurrencies, but it does not really regulate them. For this reason, the title of the work is “Cryptocurrencies and their regulation in the European Union”. The aim of the work was mainly to understand what cryptocurrency is, for which it is applicable and why it was created, what its purpose was, and to examine the views expressed by EU Member States on such a currency and to examine in depth, at the moment, the existing framework, which includes this type of currency. Both domestic and international laws, Internet resources, literature, judicial practice, opinions and other sources were analysed to achieve the goal of work. As part of the work, the author identified the reasons for the rise of cryptocurrency, its objectives and its wide range of applications, as well as the negative aspects that such currency will have. The author hadn't thought that there was so much need for regulation, cryptocurrency, and how much it had taken over the world. Considering the innovation of cryptocurrency and the fact that there is very little scientific research from the legal point of view, it is important to explain the nature of the cryptacurrency and to find out why such regulation is so necessary, as well as to understand the existing regulation, its content and possible future direction.
