Abstract

Viens no būvizstrādājumu tiesiskā regulējuma problēmjautājumiem ir sabiedrības un vides drošības aspektu ievērošana. Galvenais likumdevēja mērķis, izstrādājot normatīvus aktus šajā jomā, ir šo aspektu noteikšana un ieviešana tiesiskajā regulējumā, lai tirgus dalībniekiem būtu pienākums tos ievērot. Darba mērķis ir noskaidrot, kādas tiesiskas attiecības regulē būvizstrādājumu tiesiskais regulējums, kā tas ietekmē uz būvizstrādājumu tirgus apriti, ar kādām problemātiskajiem jautājumiem saskaras sabiedrība un dalībnieki, analizējot normatīvus aktus, juridisko literatūru un tiesu praksi. Darba uzdevums ir raksturot būvizstrādājumu tiesisko regulējumu noteikt tā nepilnības un trūkumus, sniegt risinājumus un priekšlikumus to novēršanai. Darbs sastāv no trim nodaļām. Pirmajā nodaļā autors sniedz būvizstrādājumu tiesiskā regulējuma vispārējo raksturojumu un apraksta to galvenos aspektus. Otrajā nodaļā ir analizēta būvizstrādājumu tiesiskā regulējuma problemātika un nepilnības Eiropas Savienības regulējuma tvērumā. Trešajā nodaļā ir izpētīta būvizstrādājumu neatbilstība spēkā esošajam tiesiskajam regulējumam, to iemesli, problemātika un sekas, kā arī autors piedāvā iespējamos risinājumus to noveršanai.

One of the problematic issues of legislation of the construction products is to observe the aspects of public and environmental safety. The main objective of the legislator by drafting legal acts in this field is to identify and enforce these aspects in the legislation in order for the market participants to have to comply with them. The purpose of the work is to find out what kind of legal relationships are regulated by construction products legislation, how it affects the market movement of construction products, what problems the society and the participants are facing by analyzing the legal acts, legal literature and court judgments. The work task is to characterize legislation of construction products in general, to identify its incompleteness and lacks, to provide solutions and proposals for their elimination. The work consists of three chapters. In the first chapter author provides a general description of legislation of construction products and identifies its main aspects. The second chapter analyzes the problems and the incompleteness of legislation of construction products regulation in the scope of the regulation of the European Union. The third chapter analyzes construction products nonconformity with the legislation in face of construction products, those causes, problems and consequences as well as Author also suggest possible solutions for their elimination.
