Mūsdienu straujā interneta un tehnoloģiju attīstība ir radījusi sarežģītu uzdevumu likumdevējam – kā aizsargāt personas godu un cieņu, pārlieku neierobežojot vārda brīvību. Savstarpējā komunikācija un saziņa ir ieņēmusi pavisam citu līmeni – persona savu viedokli var paust lielai sabiedrības daļai, izmantojot interneta portālu sniegto iespēju – komentāru sadaļu. Ņemot vērā pārmaiņas, ko radījis Eiropas Cilvēktiesību tiesas spriedums Delfi pret Igauniju un Eiropas Cilvēktiesību tiesas spriedumu Magyar Tartalomszolgáltatók Egyesülete un Index.hu Zrt v. pret Ungāriju attiecībā uz juridisko atbildību par aizskarošiem lietotāju komentāriem internetā, šī darba mērķis ir noskaidrot atbildīgos subjektus goda un cieņas aizskāruma gadījumā. Pētījuma rezultātā darba autore secina, ka tikai sabiedrībā zināmi, populāri masu informācijas līdzekļi var tikt saukti pie juridiskās atbildības par lietotāju komentāriem, tomēr regulējums neparedz šāda veida interneta portālu identifikāciju, kas rada problēmas interneta portālu no masu informācijas līdzekļu nošķiršanas un rada nevienlīdzīgu situāciju attiecībā uz komentāru filtrēšanas nepieciešamību. Nowadays, the rapid development of the internet and technology has paved the way for a complex endeavor for the legislator, as to protect honour and dignity of a person without excessive restriction of the freedom of expression. Communication and interaction has progressed to a completely different stage – a person is able to express his/her opinion to a wide section of general public by means of an opportunity provided by internet portals – the comments section. Taking into account the changes brought by the judgement of the European Court of Human Rights to Delfi against Estonia and the judgement of the European Court of Human Rights to Magyar Tartalomszolgáltatók Egyesülete and Index.hu Zrt v. against Hungary in regard to legal liability upon offensive comments by users on the internet, the purpose of this paper is therefore to ascertain the liable subjects in the event of defamation. The results of the research conducted by the author testify that well-known to general public, popular media can be held legally liable for the comments by users, however, the legal framework does not provide for identification of such internet portals, thus, causing a problem to distinguish an internet portal form the media and creating an unequal situation in regard to the necessity to filter comments.
