Prokurora funkcija izmeklēšanas uzraudzībā

Abstract

Ne vienmēr izmeklēšanas uzraudzība notiek, lai pēc iespējas ātrāk un efektīvāk nonāktu līdz taisnīgam krimināltiesisko attiecību noregulējumam. Lai notiktu veiksmīga izmeklēšanas uzraudzība, nepietiek vien ar uzraugošā prokurora aktīvu iesaisti. Ir nepieciešama kvalitatīva izmeklēšanas veikšana no izmeklētāja puses un izmeklētāja tiešā priekšnieka aktīva iesaistīšanās. Efektīva uzraudzības veikšana ir visu triju amatpersonu veiksmīga sadarbība, virzoties uz vienu kopīgu mērķi. Maģistra darba mērķis ir izpētīt, spēt pamatot un labāk izprast izmeklētāju un uzraugošā prokurora savstarpējo sadarbības procesu. Saprast, kādā veidā var uzlabot izmeklēšanas uzraudzību. Tai skaitā, kā uzlabot izmeklētāju un uzraugošā prokurora sadarbību, lai veicinātu veiksmīgu izmeklēšanu un tās uzraudzību. Darba uzdevumi ir noskaidrot prokurora jēdzienu un lomu kriminālprocesā, aplūkot, kā prokurora statuss izpaužas ārvalstu tiesībās, praktiski iepazīt, kā tiek veikta izmeklēšanas uzraudzība un konstatēt būtiskākās problēmas uzraugošā prokurora un izmeklētāja sadarbībā, kā rezultātā tiek veikta nekvalitatīva izmeklēšana, konstatēt iespējamās normatīvā regulējuma nepilnības, praktiski izpētīt, kādas ir būtiskākās nepilnības un kļūdas izmeklētāju un uzraugošo prokuroru darbā. Veicot pētījumu ir secināts, ka lielāko problemātiku, veicot izmeklēšanas uzraudzību, sagādā kvalitatīva izmeklēšanas veikšana. Ir nepieciešama izmeklētāju papildus izglītošana un apmācīšana.

The title of the master thesis is “The Role of Public Prosecutor in Supervision of Investigation”. The supervision of investigation does not always allow to achieve a fair and effective regulation of criminal proceedings. There is needed more than just an active contribution from the public prosecutor in order to achieve a successful supervision of investigation. It is vital that the investigator pursues qualitative investigation and that also his direct supervisor actively engages. Only by successful cooperation, where all the named officials are pursuing the same common goal, effective supervision of investigation is possible. The master thesis aims to explore, point out and also justify the mistakes of the investigators and public prosecutors, and to understand, how to improve the supervision of investigation, including, how to improve the cooperation of investigator and public prosecutor in order to ensure successful investigation and its supervision. The thesis sets following tasks: to explore the definition of public prosecutor and its role in criminal proceedings; to view the status of public prosecutor in other countries; to view how the supervision of investigation is performed in praxis, and to find the major problems in the cooperation of the public prosecutor and the investigator, which lead to low quality investigations; to ascertain the potential shortcomings in legal regulations; to explore the main shortcomings and mistakes in the practical work of investigator and public prosecutor. The thesis concludes that the main problem during supervision of investigation is achieving quality in the investigations. Additional education and instruction of investigators is needed. It is also expected from the public prosecutor to know all the nuances of investigations, even though the investigator investigates the case and would have to know the criminal case in details.
