Globalizācijas, digitalizācijas un tehnoloģiju straujā attīstība un tā ietekmē pieaugušās patērētāja tiesību aizsardzības prasības ir mudinājušas daudzas valstis ne vien pārskatīt un modernizēt noilguma institūta regulējumu atbilstoši mūsdienu tiesiskās vides prasībām, bet arī tā regulējumā nostiprināt patērētāja tiesību aizsardzību. Maģistra darbs “Noilguma materiāltiesiskie un procesuālie aspekti komercdarījumos ar patērētājiem” mērķis ir noteikt, vai Latvijā noilguma institūta regulējumā ir nostiprināta patērētāja aizsardzība attiecībās ar komersantiem, kā arī vai noilguma regulējums kopumā spēj pilnībā nodrošināt patērētājam un komersantam Satversmē garantētās tiesības uz taisnīgu tiesu. Īstenojot mērķi, tiek aprakstītas problēmas, ar kurām saskaras tiesību piemērotāji un kuras mēģināts atrisināt ar judikatūras atziņu palīdzību. Svarīgākās no tām saistītas ar komercdarījuma jēdziena interpretāciju, pieaugošām prasībām attiecībā uz kreditora atgādinājumu, lai tas pārtrauktu noilgumu, kā arī to, vai tiesām noilgums jāņem vērā pēc savas iniciatīvas (ex officio) vai tikai tad, ja uz to atsaucas patērētājs. Autore analizē minēto problēmu cēloņus un norāda uz iespējamiem uzlabojumiem noilguma regulējumā, lai nodrošinātu ne vien tiesisko noteiktību mantiskajās attiecībās, bet arī sniegtu patērētājam augstu tiesību aizsardzības līmeni. The rapid development of globalization, digitization and technology, and its impact on consumer rights protection requirements, have prompted many countries not only to review and modernize the regulation of the prescription institute in accordance with the requirements of today's legal environment, but also to strengthen consumer protection in prescription regulation in transactions with merchants. The main aim of the Master's thesis "Material and procedural aspects of prescription in commercial transactions with consumers" is to determine whether the protection of the consumer has been strengthened in the regulation of the prescription as well to evaluate whether regulation of prescription as a whole can fully ensure consumer and merchant the rights guaranteed by the Satversme to a fair trial. Implementing the goal, author describes the problems encountered by courts and its attempts to resolve through case-law findings. The most important of these are the interpretation of the concept of a commercial transaction, increasing requirements for a creditor’s reminder to interrupt the prescription, and whether the prescription should be taken into consideration by courts on its own initiative (ex officio) or only when the consumer refers to it. The author analyzes the causes of these problems and points to possible improvements in the prescription regulation in order to ensure legal certainty and higher level of legal protection for consumer.
