Taisnīgums-mīts vai realitāte tiesiskā valstī

Abstract

Maģistra darba temats ir “Taisnīgums – mīts vai realitāte tiesiskā valstī”. Taisnīgums ir viens no demokrātiskas tiesiskas valsts pamatprincipiem. Latvijas Republikas Satversmes preambula paredz: “Uzticība Latvijai, latviešu valoda kā vienīgā valsts valoda, brīvība, vienlīdzība, solidaritāte, taisnīgums, godīgums, darba tikums un ģimene ir saliedētas sabiedrības pamats”. Taisnīgums kā vispārējais tiesību princips izriet no Satversmes kā valsts pamatnormas. Tomēr, vai varam apgalvot, ka taisnīgums patiesi tiek arī īstenots? Maģistra darba mērķis ir izpētīt, vai tiesiskā valstī patiesi pastāv taisnīgums vai arī tas ir tikai mīts. Lai šo mērķi sasniegtu, maģistrante izvirzīja šādus uzdevumus – analizēt kā laika gaitā ir mainījies taisnīguma ideāls, kādi priekšnoteikumi vai mehānismi nosaka taisnīguma robežas un vai taisnīgums vienmēr prevalē pār citiem demokrātiskas tiesiskas valsts pamatprincipiem. Ņemot vērā, ka izvēlētā tēma ir pietiekoši plaša, maģistrante galvenokārt analizē taisnīgumu nodokļu tiesībās. Darba rezultātā maģistrante ir secinājusi, ka, tā kā cilvēku izpratne par taisnīgumu atšķiras un līdz ar to ar likumu noteikts taisnīgums būs tikai relatīvs taisnīgums, jānonāk skeptiskā pozīcijā, ka taisnīgums tiesiskā valstī ir mīts.

The topic of the Master’s thesis is “Justice- myth or reality in a legal state”. Justice is one of the fundamental principles of a democratic legal state. The preamble of the Constitution of the Republic of Latvia states: “Loyalty to Latvia, the Latvian language as the only official language, freedom, equality, solidarity, justice, honesty, work ethic and family are the foundations of a cohesive society”. Justice, as the general principle of law, stems from the Constitution as the basic norm of the state. However, can we truly say that justice is actually being enforced? The aim of the Master's thesis is to analyze, whether justice really exists in a legal state or whether it is just a myth. In order to achieve this aim, the magistrate sets out the following tasks: to analyze how the ideal of justice has changed over time, what preconditions or mechanisms define the boundaries of justice and whether justice always prevails over other fundamental principles of a democratic legal state. Given that the topic chosen is sufficiently broad, the magistrate mainly analyses justice in tax law. During the research, the magistrate has concluded that since people’s understanding of justice is different and therefore justice will only be relative justice, it shall be of a true skepticism, that justice is a myth.
