Lietas sagatavošana iztiesāšanai ir civilprocesa obligātā stadija, kurā tiesa un lietas dalībnieki veic vairākas nozīmīgas procesuālās darbības, kuras atstāj nopietnu iespaidu uz turpmāko lietas izskatīšanas procesu. Darba ietvaros pētīts lietas sagatavošanas iztiesāšanai kā procesa stadijas mērķis un iespējas uzlabot procesu labākai mērķa sasniegšanai, salīdzinot Latvijas regulējumu ar Skandināvijas valstu regulējuma aspektiem. Autore īpaši aplūkojusi sagatavošanas sēžu nozīmi procesā kā arī tiesas nolēmumu iespējas lietas sagatavošanas iztiesāšanai procesā, tajā skaitā pieņemot spriedumu. Darba mērķis ir izpētīt un uzsvērt lietas sagatavošanas iztiesāšanai nozīmi lietas virzībā, piedāvājot arī iespējamos uzlabojumus procesa efektivitātes veicināšanai. Pētījuma ietvaros autore ir analizējusi lietas dalībnieku statusu nozīmi lietas sagatavošanā, sagatavošanas sēžu nepieciešamību, kā arī tiesas iespējas izskatīt lietu pēc būtības vēl sagatavojot lietu iztiesāšanai. Darba rezultātā autore secina, ka lietas sagatavošanas iztiesāšanai mērķis šobrīd netiek pilnībā sasniegts, kamdēļ tiesā ir aktīvāk jāizmanto tām Civilprocesa likumā paredzētās tiesības gan attiecībā uz sagatavošanas sēžu rīkošanu, gan lietas dalībnieku sodīšanu par negodprātīgu tiesību un pienākumu izmantošanu. Autore arī piedāvā veikt papildinājumus Civilprocesa likumā, paredzot iespēju tiesai taisīt spriedumu sagatavošanas sēdē, ja atbildētājs prasību ir atzinis pilnā apmērā. Preparatory stage in civil procedure is a mandatory stage, where the court and the parties take a number of important procedural steps that have a serious impact on the further proceedings. The study examines the aim of preparation of the case for trial and possibilities to improve the process to achieve the goal, comparing the Latvian regulation with the regulatory aspects of the Scandinavian countries. The author has specifically considered the importance of preliminary hearings in the process, as well as the possibilities of court rulings in the case preparation stage, including making of a final judgment. The aim of the thesis is to investigate and emphasize the importance of case preparation process, also offering possible improvements in order to make the process more efficient. Within the framework of the research, the author has analysed the importance of the status of the participants in the preparation of the case, the necessity of preliminary hearings, as well as the possibilities of the court to pass a judgement while preparing the case for trial. In the result, the author concludes that the purpose of preparatory stage is not fully achieved, therefore, courts should more actively use the rights provided in the Civil Procedure Law for organizing preparatory hearings and punishing the parties for the dishonest use of rights and obligations. The author also proposes to make amendments to the Civil Procedure Law, providing opportunity for the court to pass a judgment in the preparatory meeting if the defendant fully admits the claim.
