Vienotais uzraudzības mehānisma izveidošana ir unikāla Eiropas Savienības konstitucionālajā un administratīvajā sistēmā. Tā ir finanšu uzraudzības sistēma, ko veido ECB un nacionālās kompetentās iestādes. Tas, ka vienotā uzraudzības mehānisma pamatā ir dažādi autonomi elementi, kas atrodas gan nacionālajā, gan Eiropas Savienības līmenī, rada plašas sekas no juridiskās zinātnes viedokļa. Vienotā uzraudzības mehānisma īpašā struktūra rada jautājumus par mijiedarbību starp dažādajiem administratīvajiem līmeņiem un veidiem, kā dažādu līmeņu dalībnieki sadarbojas, lai īstenotu kopīgus uzdevumus un politiskos mērķus. Šī iemesla dēļ ir aktualizējies jautājums par kompetenču sadali starp ECB un nacionālajām kompetentajām iestādēm. Šajā darbā tiek apskatīti problēmjautājumu, kuri izriet no Vienotā uzraudzības mehānisma tiesiskā regulējuma, kā arī šo jautājumu iespējamie risinājumi. The institutional design of the Single Supervisory Mechanism is unique in the EU constitutional and administrative framework. It is a system of financial supervision consisting of the ECB and the national competent authorities. The fact that the Single Supervisory Mechanism is essentially composed of different and autonomous elements, located both at national level and the level of European Union, entails far-reaching implications from the legal and political science perspective. This specific structure also raises questions concerning the interactions between different levels of administration, and the ways that the actors situated at different levels cooperate to pursue common tasks and policy objectives. This reason has raised the issue of the allocation of competences between ECB and national competent authorities. This paper deals with the issues arising from the legal framework of the Single Supervisory Mechanism, as well as possible solutions to these issues.
