Bērna vislabāko interešu princips: tiesības uzaugt ģimenē aspekts

Abstract

Maģistra darba tēma ir “Bērna vislabāko interešu princips; tiesības uzaugt ģimenē aspekts”. Bērna labāko interešu princips ir ļoti plašs un ne visiem ir saprotams, ko tas ietver. Šajā pasaulē bērns ienāk konkrētā ģimenē, taču ne visi bērni uzaug ģimenē un dzīvo ar vecākiem un saņem pilnvērtīgu aprūpi, un ne visiem bērniem tiek nodrošinātas viņu tiesības. Katra bērna labākajās interesēs ir uzaugt ģimenē, jo tikai ģimenē bērns apgūst sabiedrībā nepieciešamās lomas, uzkrāj sociālo pieredzi un iemaņas, kas ir svarīgas nākotnē, kā arī gūst priekštatu par savstarpējām attiecībām un vērtībām. Maģistra darba mērķis ir noskaidrot jēdziena “bērna vislabāko interešu princips” nozīmi no bērna tiesībām uzaugt ģimenē aspekta. Pētījuma rezultātā ir veikti secinājumi par ģimenes kā sociālā institūta nozīmīgumu bērna socializācijas procesā, kā arī izvērtēts jēdziens “bērna labākās intereses”, noskaidrots, ka likumos skaidrotais jēdziens “bērns” ir ļoti vispārīgs un ir izdarīti secinājumi par statistiku, kura norāda par vecāku aizgādību tiesību atņemšanu un atjaunošanu.

The theme of the Master's thesis is “Child's best interest principle; the right to grow up in the family aspect”. The principle of the best interests of the child is very broad and not everyone understands what it involves. In this world, a child is born in a certain family but not all children have the opportunity to grow up in a family and live with their parents, receive full care and not all children are provided by their rights. It is in the best interests of each child to grow up in full family, because only in the family child learns the necessary roles in society, accumulates social experiences and skills that are important in the future. As well, they gain an idea of mutual relationships and values. The aim of the Master's thesis is to clarify the meaning of the child’s best interest principle from the child’s right to grow up in the family aspect. As a result of the research, conclusions have been made about the importance of the family as a social institute in the socialization process of the child and the concept of “the best interest of the child” has been estimated. It has been clarified that the concept of the child in law is very ambiguous and there have been made conclusions about statistics, which shows the deprivation and restoration of parental rights.
