Pētījuma mērķis ir identificēt tendences un problēmas administratīvo tiesu spriedumos, vērtējot un nosakot nemantiskā kaitējuma atlīdzinājumu, pēc grozījumiem Valsts pārvaldes iestāžu nodarīto zaudējumu atlīdzināšanas likumā, aizstājot personiskā un morālā kaitējuma jēdzienus ar nemantisko kaitējumu, lai rezultātā noskaidrotu, kā praksē tiek īstenots jaunais likuma regulējums un nemantiskā kaitējuma jēdziens. Ar grozījumiem likumā tiek uzlabota tiesību uz atlīdzinājumu izpratne, lai tiesām būtu vieglāk noteikt atbilstīgu atlīdzinājuma līdzekli, koncentrējoties uz atlīdzinājuma funkcijām, taču pētījuma rezultātā atspoguļotas spriedumos konstatētās problēmas nemantiskā kaitējuma vērtēšanā un atbilstīga atlīdzinājuma noteikšanā pēc grozījumiem Valsts pārvaldes iestāžu nodarīto zaudējumu atlīdzināšanas likumā, nenošķirot nemantisko kaitējumu no morālā un pārlieku citējot likuma normas. The aim of the study is to identify trends and problems in judgments of administrative courts in evaluating and determining compensation for non-pecuniary harm, following amendments to the Law on Compensation for Damage Caused by State Administration Institutions, replacing the concepts of personal and moral harm with non-pecuniary harm, in order to find out as a result how the new regulation of the law and concept of non-pecuniary harm are implemented in practice. Amendments in the law improve the understanding of the right to compensation to make it easier for courts to determine the appropriate remedy, focusing on functions of compensation, however, as a result of the study, the problems identified in the judgments in assessing non-pecuniary harm and in the appropriate compensation after amendments in the Law on Compensation of Damage Caused by State Administration Institutions, without separating the non-pecuniary harm from moral harm and over quoting the norms of the law.
