Nozieguma mēģinājums

Abstract

Darba autore izstrādājusi bakalaura darbu par nozieguma mēģinājumu. Veiktie noziedzīgie nodarījumi var izpausties kā pabeigti un kā nepabeigti nodarījumi. Nozieguma mēģinājums ir viens no nepabeigta nozieguma veidiem. Ņemot vērā, ka nozieguma mēģinājums ir patstāvīgs institūts, to raksturo atsevišķas pazīmes un īpatnības, kurām autore pievērsusies šī darba izstrādes ietvaros. Bakalaura darbā tiek pētīta un analizēta nozieguma mēģinājuma vēsturiskā attīstība, tāpat darbā tiek pētīts nozieguma mēģinājuma jēdziens, kā arī tā veidi, analizējot to atšķirīgās pazīmes. Darba ietvaros autore pievērsusies arī Krimināllikumā paredzētā nozieguma mēģinājuma jēdziena regulējuma salīdzināšanai ar ārvalstu normatīvajos aktos paredzētajiem regulējumiem. Darba mērķis ir uzsvērt nozieguma mēģinājuma atšķirīgās pazīmes, lai pareizi kvalificētu noziedzīgu nodarījumu un pareizi noteiktu personas kriminālatbildību atbilstoši izdarītajam. Darba uzdevumi ir salīdzināt Krimināllikuma nozieguma mēģinājuma regulējumu ar tās vēsturiskajiem regulējumiem Latvijas Republikas teritorijā, izpētīt nozieguma mēģinājuma jēdzienu juridiskajā literatūrā, nosakot tā pazīmes, izanalizēt nozieguma mēģinājuma veidus un problemātiku šo veidu norobežošanā. Darbs sastāv no sešām nodaļām un tā rezultātā izstrādātas 13 tēzes. Darbs kopumā izklāstīts 53 lappusēs un darbā izmantoti 59 dažādi avoti, iekļaujot tajos gan literatūras avotus, gan tiesu praksi.

The author of the work has made Bachelor thesis about criminal attempt. There are different ways of committing crime – as a completed criminal offence and as an incomplete criminal offence. The attempted crime is one of the incomplete criminal offence types. Keeping in mind that criminal attempt is independent institute of Criminal Law, it can be characterized with separate features and characteristics, to whom the author has paid special attention to. In the Bachelor's thesis is studied and analysed the historical development of criminal attempt, likewise the concept of criminal attempt, as well as the types of criminal attempt and the analysis of their different characteristics. The author has also paid attention to the Criminal Law of Republic of Latvia intended criminal attempt comparison with foreign normative statutory criminal attempt regulations. The aim of the Bachelor thesis is to research the criminal attempt institute diverse characteristics, so that can properly qualified criminal attempt. The task of the work is to compare the Criminal Law regulation with the historical regulations, to research criminal attempt concept and its characteristics, to compare the types of it and to define its distinct differences, as well as to research the problematics. The work is divided in to six parts and in the Bachelor has been made 13 theses. The work has been set out in 56 pages and to make the work there has been used 45 different sources that include both literature and case law.
