Rīcība ar kopīpašumu

Abstract

Bakalaura darba temats ir “Rīcība ar kopīpašumu”. Rīcība ar kopīpašumu nozīmē, ka pastāv kopīpašums, kurš pieder vairākām personām, un katram no šīm personām (fiziskās personas/juridiskas personas) ir gan tiesības un pienākumi vienam pret otru, gan pret kopējo lietu. Bakalaura darba mērķis ir aplūkot kopīpašuma tiesības rašanās pamatus, izprast jēdziena “Kopīpašums” būtību, rīcību ar kopējo lietu, lietošanas tiesības un attiecīgi kā var mainīties pienākumu un ienākumu sadalījums, kā arī par Civillikuma normu modifikāciju Dzīvokļa īpašuma likumā un Dzīvojamo māju pārvaldīšanas likumā. Darbu veido ievads, trīs nodaļas, kopsavilkums, izmantotā literatūra un avoti. Darba ievadā ir pamatota tēmas aktualitāte, norādīts mērķis un uzdevumi. Pamatojoties uz zinātnisko avotu teorētisko analīzi ir izdarīti secinājumi. Darbā izmantotās literatūras avotu saraksts sastāv no Latvijas Republikas normatīvajiem aktiem, juridiskās literatūras, elektroniskajiem informācijas avotiem, rakstiem, komentāriem un tiesu prakses materiāliem.

The subject of bachelor's work is “joint ownership”. Joint ownership means that there is a joint ownership of several persons and each of these persons (natural persons/entities) has both rights and obligations against each other and against the common case. The purpose of the work of the bachelor is to examine the grounds for the creation of a joint ownership right, to understand the nature of the concept of “joint ownership”, to act with the common case, the right of use and, as the case may be, the division of duties and income, as well as the modification of the norms of the Civil Law to the Law on Housing Property and the Law on the Management of Residential Houses. The work consists of an introduction, three chapters, a summary, the literature and sources used. The job introduction is based on the subject's focus, indicates the purpose and tasks. Conclusions have been drawn on the basis of a theoretical analysis of scientific sources. The list of sources of literature used at work shall consist of regulatory enactments of the Republic of Latvia, legal literature, electronic sources of information, articles, comments and case-law materials.
