Bakalaura darba “Nekustamā īpašuma nodokļa piemērošanas problemātika” mērķis ir noskaidrot, kādas regulējuma problēmas pastāv nekustamā īpašuma nodokļa piemērošanā Latvijā. Bakalaura darbā ir izvērtētas un aplūkotas trīs dažādas problēmas, kas var rasties piemērojot nekustamā īpašuma nodokli, konkrēti – likuma “Par nekustamā īpašuma nodokli” normas. Jāuzsver, ka visas šīs piemērošanas problēmas rada potenciālus pamattiesību aizskārumus. Likumdevējam būtu nepieciešams veikt likuma grozījumus, lai tās novērstu. Lai analizētu piemērošanas problemātiku, ir veikta tiesību normu salīdzināšana, veikts konstitucionalitātes (satversmības) tests, analizēti pamattiesību principi, t.sk. vienlīdzības princips. Ir apskatīts arī kā līdzīgi problēmjautājumi tiek regulēti ārvalstīs, analizēta tiesību normu, kas regulē iespējamās problēmas, ģenēze, kā arī veikta izvērsta tiesu prakses izpēte. Darba ir sniegti iespējamie problēmu risinājumi, kā arī dotas norādes uz to, kā nepieciešams veikt normatīvā regulējuma izmaiņas. The purpose of bachelor paper “Issues of applying Law on Immovable Property Tax” is to determine, what kind of legislative problems exist in the application of Law on Immovable Property Tax in Latvia. In this bachelor paper three different problems are assessed and looked over, which may rise when the Law on Immovable Property Tax is applied. It is necessary to mention that all of the three identified problems may cause potential violations of fundamental rights. It would be essential for legislator to amend the Law in order to remove the problems. In order to analyse the problems in application of the Law, comparison of legal provisions was performed, it was assessed whether problematic legal provisions comply with fundamental rights (constitutional test), principles of fundamental rights, including the principle of equality, were analysed. It has been reviewed how such problems are dealt with abroad, the creation of problematic legal provisions was analysed, as well as wide analyses of court practice regarding the mentioned problems. In this paper possible solutions to problems of applying the Law is given, clear directions on how the Law should be amended is given too.
