Sūdzības par ārstniecības personu pasīvu rīcību vai nekvalitatīvu pakalpojumu sniegšanu ir ļoti daudz, taču šo personu saukšana pie kriminālatbildības, kura paredzēta Krimināllikuma 138. pantā, notiek reti. Bakalaura darba mērķis ir rast atbildes uz juridiskiem šķēršļiem, kas pastāv, kad nodarījuma faktiskie un juridiskie apstākļi neatbilst Krimināllikumā 138. pantā paredzētajam noziedzīgā nodarījuma sastāva pazīmēm, un traucē saukt personu pie likumā paredzētās kriminālatbildības.Prakses problēmjautājumus, lielākoties, rada neizpratne par ārstniecības personas - īpašā subjekta - statusu, kā arī par cēloņsakarības pastāvēšanas konstatēšanu. Bakalaura darba uzdevums ir izpētīt Krimināllikuma 138. panta noziedzīga nodarījuma objektīvās puses un subjekta raksturojumu. Veikt tiesu prakses pētījumu. Analizēt cēloņsakarību starp rīcību un kaitīgajām sekām un ārvalstu regulējumu, kā arī izpētīt vēsturisko regulējuma attīstību Latvijā. There are many complaints about passive actions or poor quality services provided by medical practitioners, but the criminalization of these persons provided for in Article 138 of the Criminal Law is rare. The aim of the present Bachelor's thesis is to find answers to legal obstacles that exist when the factual and legal circumstances of the offense do not correspond to the characteristics of the composition of the criminal offense, as described in Article 138 of the Criminal Law, and prevent the person from being held criminally liable under the law. The issues of the practice are mostly caused by a lack of understanding of the status of a medical practitioner - a special subject -, as well as of the detection of existence of a causal link. The goal of the Bachelor's thesis is to study the character of the objective part of the criminal offense and the subject of the criminal offense, as described in Article 138 of the Criminal Law. To conduct a law case study. To analyze causal relationships between an action and its harmful consequences and foreign regulations, as well as to study the historical development of regulation in Latvia.
