Abstract

Maģistra darbā “Atbildība par dzīvnieka nodarītu kaitējumu” ir izvirzīts viedoklis par piemērojamo atbildības modeli dzīvnieka nodarīta kaitējuma gadījumā. Tāpat darbā ir aplūkoti atsevišķi tiesību jautājumi, piemēram, par atbildīgo personu par dzīvnieka nodarījumu, kā arī ir analizēts dzīvnieka jēdziens, lai izvairītos no nekonsekventas dažādu terminu lietošanas. Darba rezultātā ir izvirzīti priekšlikumi, kas veicinātu vienotu izpratni par dzīvnieka nodarīta kaitējuma atbildību, definējot gan atbildīgo personu, gan piemērojamo atbildības modeli, tāpat ir piedāvāts vienota apzīmējuma definējums, kas izmantojams Civillikuma deviņpadsmitās nodaļas ceturtās apakšnodaļas ietvaros.

The Masters Thesis “Liability for the damage caused by an animal” sets out an opinion on the applicable liability model in case of damage done by an animal. Even further, it analyses certain legal issues such as the responsible person for the damage caused by an animal, as well as the terminology of animal in order to avoid inconsistent use of different terms. The results of the Thesis describes different proposals that would improve a common understanding of the liability for the damage made by an animal, defining the responsible person, as well as the applicable liability model and the common definition of term is proposed that should be used in the sub-chapter 4 of the chapter 19 of the Civil Law.
