In Master’s Thesis „The right not to testify in criminal procedure” has been performed content analysis, which follows from the basic principles enshrined in the Constitution of the Republic of Latvia, the Criminal Procedure Law, European Union legislation and international documents in the field of human rights. The author has described the right not to testify to entities and has given an assessment of the right not to testify as a right not to incriminate oneself in criminal procedure. The author has given an assessment of the refusal to show the importance of achieving a fair settlement of criminal relations. In investigating legal literature, legislation and judicial practice, the author has analysed the consequences of which a person has refused to testify, and has identified cases in which a person's rights may not be limited. The results and proposals of the Master's thesis are reflected in both the discussion of chapters and sub-chapters and in the part of conclusions.
