Tiesas nolēmumu argumentācijas īpatnības

Abstract

Maģistra darbā ir analizētas tiesas nolēmuma kā juridiskā teksta rakstīšanas veida un juridiskā materiāla loģiskas analīzes rezultāta īpatnības, ievērojot konkrētos faktiskos un tiesiskos apstākļus; aprakstītas vispārīgās prasības tiesas nolēmumam, apskatīti tiesas nolēmuma sagatavošanas pamatnoteikumi un tā sastādīšanas algoritms, uzsverot prasību par izklāsta loģiskumu un argumentāciju. Par maģistra darba mērķi autore izvirzījusi tiesu prakses izpēti saistībā ar tiesas nolēmumu motīvu daļas kvalitāti, t.i., tās skaidrību un uztveramību. Darba rezultāti liecina, ka kvalitatīvs tiesas nolēmums viennozīmīgi vairo sabiedrības uzticēšanos tiesām un valstij, samazina nolēmuma pārsūdzības iespējas un vairo nolēmuma labprātīgas izpildes iespējamību. No minētā izriet secinājums, ka tiesneša galvenais uzdevums ir spriest taisnīgu tiesu, kas ir iespējams, ja tiesnesis, izskatot lietu, domās kritiski un iedziļināsies tajā.

The Master’s paper analyzes the peculiarities of the court’s decision as the type of legal text writing and the logical analysis of legal material, taking into account the specific factual and legal circumstances; describes the general requirements for a court decision, discusses the basic rules for the preparation of a court decision and the algorithm for its preparation, emphasizing the requirement of logic and argumentation of the presentation. The aim of the Master’s paper is to investigate the case law in relation to the quality of the motives of court decisions, i.e. its clarity and perception. The results of the work show that a high-quality court decision unequivocally enhances public confidence in the courts and the state, reduces the possibility of appealing the ruling and increases the probability of voluntary execution of the ruling. It follows from this that the main task of the judge is to judge a fair trial, which is possible if the judge thinks critically and examines the case.
